OPASKWAYAK CREE NATION BY-LAW By-Law Number: 2018-01 Dated this /3 41 day of ~6---r. , 2y 2018. REVOKING BY-LAW AT A DULY CONVENED MEETING of Onekanew mena Onuschekewuk, formerly known as Chief and Council, held in the Onekanew mena Onuschekewuk Chambers on Opaskwayak Cree Nation Reserve No. 21E; WHEREAS Opaskwayak Cree Nation, formerly known as The Pas Band of Indians, through its Onekanew mena Onuschekewuk, formerly known as Chief and Council, is a First Nation with rights and powers of inherent Self Government, and possessing inherent Treaty and Aboriginal rights as affirmed under sections 25 and 35 of the Constitution Act of Canada, 1982, and recognized by and also exercising certain authorities, powers and rights pursuant the Indian Act, RSC 1985, c.I-5; AND WHEREAS Opaskwayak Cree Nation, through its Onekanew mena Onuschekewuk, pursuant to sections 81 and 83 of the Indian Act, possesses the authority to make, enact, amend or rescind or repeal By-Laws pursuant to the Indian Act; AND WHEREAS a By-Law titled "By-Law No. 6" SOR/73-414, commonly known as 'A by-Iaw to regulate the use of slingshots and bows & arrows in residential areas on The Pas Reserve 21E,' was enacted on the 6th day of July, 1973, by the Onekanew mena Onusehekewuk (referred to at the time as `Chief and Council') of Opaskwayak Cree Nation (referred to at the time as 'The Pas Band of Indians') and duly approved and enacted by the Minister, pursuant to the Indian Act, and was recognised and accepted as a valid statutory instrument and enactment; AND WHEREAS the Onekanew mena Onuschekewuk have determined that the By-Law, titled "By-Law No. 6," SOR/73-414, commonly known as 'A by-law to regulate the use of slingshots and bows & arrows in residential areas on The Pas Reserve 21E,' is no longer required in its current form, and should be rescinded or repealed, by this further By-Law and valid statutory Instrument (herein known as the 'Instrument') NOW THEREFORE the Onekanew mena Onuschekewuk, exercising powers and authorities conferred by section 81 of the Indian Act, by this Instrument and By-Law, hereby rescinds, repeals, revokes and annuls the By-Law titled "By-Law No. 6," SOR/73-414, commonly known as 'A by-law to regulate the use of slingshots and bows & arrows in residential areas on The Pas Reserve 21E,' and declares it of no force and effect. FURTHER the Onekanew mena Onuschekewuk direct that this Instrument and By-Law be published forthwith in the First Nation Gazette, and further published forthwith in the Natotawin as a newspaper with general circulation on Opaskwayak Cree Nation reserve lands, and that it shall come into force on the day of first publication; THIS BY-LAW IS APPROVED AND PASSED AT A DULY CONVENED MEETING OF THE QUORUM OF THE ONEKANEW MENA ONUSCHEKEWUK OF THE OPASKWAYAK CREE NATION, IN THE PAS, MANITOBA, THIS i3541 DAY OF F RvARV , 2018.
