CHIPPEWAS OF KETTLE & STONY POINT BY-LAW NO. 24 BEING A BY-LAW FOR THE REDUCTION OF 111E RATE OF SPEED IN A SCHOOL ZONE WITHIN THE CONFINES OF THE KETTLE & STONY POINT LANDS WHEREAS Sections 81 (1)(b), (c), (q) and (r) of the Indian Act empowers the Council of a Band to pass by-laws to provide for the regulation of traffic, the observance of law and order, any matters ancillary thereto, and a penalty for the violation thereof; AND WHEREAS the Council of the Kettle & Stony Point First Nation wishes to establish a by-law to designate a school zone and provide for the reduction of speed on a highway in the said school zone within the confines of the Kettle & Stony Point Lands; AND WHEREAS it is deemed necessary to regulate of the rate of speed in the school zone to provide for the safety of all children and persons of the Kettle and Stony Point Lands; NOW THEREFORE the Council of the Kettle and Stony Point First Nation hereby enacts a by-law as follows: SHORT TITLE 1 This by-law may be cited as the "Rate of Speed in a School Zone By-Law". INTERPRETATION 2 In this by-law (1) "Council" means the elected Council of the Kettle and Stony Point First Nation; (2) 'Lands" means the geographical area set aside for the use and benefit of the Kettle and Stony Point First Nation. (3) "School Zone" means the portion of Indian Lane located on the Kettle and Stony Point First Lands that adjoins the main entrance to or exit from the Hillside Public School and that is within 150 metres along Indian Lane in either direction; (4) "School Days" means all days of Monday, Tuesday, Wednesday, Thursday and Friday from 8:00 a.m. to 5:00 p.m. local time.
Rate of Speed in a School Zone By-Law No. 24 Page 2 RATE OF SPEED 3 No person shall drive a motor vehicle at a rate of speed greater than 40 kilometres per hour in the School Zone on School Days. _ PENALTY 4 Any person who violates any provisions of this by-law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding $200.00 (two-hundred dollars).
