BY-LAW NO. 9 Being a by-law to regulate the ownership and control of dogs on the reserve. WHEREAS under Section 8l(a) of the Indian Act R.S., c.149, SI the Band is is empowered to make by-laws: to provide for the health of residents of the reserve. AND WHEREAS it is considered that a control on the ownership of dogs on the reserve is applicable to the general health and safety of residents, NOW THEREFORE the Council of the Long Lake #58 Band of Indians enacts as a By-Law thereof the following: 1) In this by-law: (a) "Council" means the Council of the Long Lake #58 Band of Indians as defined in the Indian Act. (b) "Reserve" means Long Lake Indian Reserve #58 set apart for the use of the Band. (c) "Dog Registration Officer" means the person appointed by Council for the purpose of controlling dogs on the Reserve. Long Lake Indian Reserve #58, Special Constables. 2) Council will appoint The Special Contables for the purpose of enforcing this by-law. 3) All dogs will registered on an annual basis no later than March 31st each year. 4) The registration fee will be five dollars for a male or neutered fe­ male dog, and ten dollars for a female dog and further ten dollars fee for extra dogs per household. 5) Council will at the time of registration, provide the dog-owner with a receipt and numbered "dog-tag" for each dog registered. 6) No dog shall be allowed to run at large in populated areas of the reserve, unless accompanied by the owner or other responsible person capable of exercising control over the animal. 7) No family shall be permitted to own more than two pets or four work­ ing dogs or two pets dogs and four working dogs. 8) The Special Constables may capture any dog which is deemed, in his opinion, to be running at large and causing a public nuisance, 2
and the owner of the dog will be allowed to redeem the animal within a forty-eight hour period, after which time the dog may be destroyed. 9) The fee payable for redemption of a captured dog will be ten dollars for the first offence and thereafter twenty dollars each time. 10) Any person who violates the provision of this by-law shall be guilty of an offence and liable on summary conviction to a fine of twenty- five follars, or imprisonment for a period of five days or both such fine and imprisonment.
