The Kipawa Band of Indians By-law # 1.79_____________ Being a By-law concerning - The prevention of disorderly conduct and nuisances. Whereas paragraphs C),D),and R), of Sec. 81 of the Indian Act empower the council of a band to make By-laws respecting % the prevention of disorderly conduct and nuisances, the observance of law and order, and the imposition of a penalty for the violation thereof; Whereas it is deemed to be expedient to protect the prosperous,or satisfactory conditionc-f the Inhabitants of the Kebaowek Indian Reserve; 1. In this By-law; A) "Counci 1" -means the Council as defined in the Indian Act of the Kipawa Band of Indians; B) "Reserve" - means the track of Land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Kipawa Band of Indians, C) "Indian" - means an Indian, being either male,or female, as outlined in the Indian Act R.S. ,c.149,s.l 2. No other person , except an Indian (born) may occupy,use, reside or exercise any right to a building within the limits of the Reserve , without first having obtained permission from the Band Council.
3. It is forbidden for all other persons other than an Indian (born) to possess, as titled owner , any buildings or property within the limitsof the Reserve. 4. No person with a criminal record, other than a male or female Indian, can reside or occupy a building on the Reserve. 5. The Band Council will have the right to expel, immediately or following modalities which they will determine, any person who contravenes the present regulation. 6. The eviction notice can either be verbal or in writing. 7. In default by a person(s) to respect the eviction notice, the Reserve Police force may, at the request of the Band Council, use the necessary force to evict the said person(s). 8. Failure to abide by these By-laws will be dealt on summary conviction of a fine not exceeding One Hundred (100.) Dollars or imorisonment for a term not exceeding thirty(30) days , or both, R.S., c . 149, s .80.
