ESKASONI BAND OB INDIANA BY-LAW 7-31(a) Being a By-Law to provide for the protection of the water supply; Whereas paragraph (1) of section 81 of the Indian Act empowers the Council of a band to make by-laws respecting the construction and regu­ lation of the use of public wells, cisterns, reservoirs, and other water supplies, and the imposition of a penalty for the violation thereof, and whereas it is deemed necessary for the protection of the water supply of a E s s ka a so b n y i -, l aw t he t r h e e f o f r o e l , l ow t i h n e g ; Council of the Eskasoni Band of Indians enacts 1. In the By-Law: (a) council means the council (as defined in the Indian Act) of the Eskasoni Band. (b) "mountain road spring area" shall refer to the approaches, the spring, pumphouse, and the excayated area and drainage immediately adjacent to the pumphouse situated at the west end of Eskasoni off Mountain Road. (c) maintenance or improvement purposes shall be determined by Council or its agent. 2. No person at any time (save for maintenance or improvement) shall cause to be removed from mountain road spring irea an> manner of earthern material, rock, or gravel. 3. No person at any time (save for maintenance or improvement) shall cause to be delivered, left, or dumped, any material or any form of refuse at the mountain road spring area. 4. The Eskasoni Band Council or its agent may at their discretion erect signs indicating the actions prohibited herein and the penalty pro­ vided, and may create such barriers as may be deemed necessary by Council or its agent. 5. Any person violating the preceding sections shall be liable upon summary conviction before a judge to a penalty not exceeding one hundred dollars, or imprisonment for a term not exceeding thirty days, or both, as provided in section (r) for a violation against section 81 of the Indian Act. * * APPROVED AND PASSED AT DULY CONVENED MEETING OF THE ESKASONI BAND COUNCIL THIS 17th DAY OF JUNE, 1981.
