F' KASONI BAND _OF INDIA BY-LAW 6-81 soft./8A-680 Being a By-Law to provide for the regulation of the construction, repair, and use of buildings; Whereas paragraph (h) of section 81 of the Indian Act empowers the Council of a band to make by-laws respecting the regulation of the construction, repair, and use of buildings, whether owned by the band or by individual members of the band, therefore, the Council of the Eskasoni Band enacts as a by-law the following: 1. In the By-Law: (a) council means the Council (as defined in the Indian Act) of the Eskasoni Band. (b) dwelling shall mean any structure which is intended for use as a residence of persons. * •% (c) agreement shall mean a written document as may be prescribed by Council and shall be signed by the allottees and repre­ sentative of Council. (d) the parent actually providing the shelter, clothing, and board for the minor children, and the said parent living with the minor children, shall be deemed by Council to have custody of said children. (e) band member means a member of the Eskasoni Band of Indians. 2. All band allotted dwellings will be allotted by Council through a Band Council Resolution. 3. A band member who is allotted a dwelling by Council must sign an agreement agreeing to abide by this by-law: (a) In the case of a new dwelling, immediately upon the expendi­ ture of total funds allotted for such dwelling. (b) In the case of an existing dwelling, immediately upon vacancy. 4. No person, during or after construction of a dwelling allotted by Council, shall sell any materials which have been purchased for said dwelling. 5. Subject to section (4) herein, any person who sells any materials from the allotted house during the course of construction of same shall be required to replace any materials sold at his/her own cost, and further purchasing of materials and/or labor from the allotted funds shall be suspended until such time restitution of materials has been made in full.
