REPEALING BY-LAW By-Law No. 1998 Intoxicants The English River First Nation WHEREAS section 85.1 o f the Indian Act empower the Council of English River First Nation to pass by-laws to provide for the safety and welfare o f the membership, matters arising out o f or ancillary to exercise of power under this section and the imposition o f a penalty for the violation o f any such by-law; WHEREAS the Council of the English River First Nation is desirous o f preserving the treaty rights o f maintaining peace and good order between each other, including the prohibition of the use of intoxicants on the reserve; WHEREAS the Council of the English River First Nation did enact By-law No. 1988 on the 3rd day of August, 1988, pursuant to Section 85.1 of the Indian Act. AND WHEREAS the said Council is of the opinion that such a by-law is not required at this time, due to the lenient imposition of punishment. NOW THEREFORE the Council of the English River First Nation enacts as a by-law thereof the following: 1. By-Law No. 1988.1 enacted on the 3rd day of August, 1988, and being a By-law on the Reserve to provide prohibition of the use of intoxicants on English River First Nation is hereby repealed.
