Curfew By-Law No. 1998.01 Title: A By-law to regulate Curfew hours in the English River First Nations Band. Short title: E.R.F.N. Curfew By-law Whereas the Chief and Council representing the membership of the English River First Nation Band of Indians desires that a By-law be instituted to regulate the nocturnal activities of the youth of the English River First Nation Band No. 192A within certain prescribed hours and Whereas the English River First Nation Band of Indians wishes to control certain activities of the said youth and to preserve their traditional and treaty rights of maintaining peace and good order in the community and Whereas the Chief and Council representing the membership of the English River First Nation Band of Indians will establish certain requirements in the Curfew By-law under the authority invested with the English River First Nation Band pursuant to the Indian Act R.S.C 1985 c. 1-5 ss 81.(l)(c)(d)(p2) and (r) Therefore, under said authority the Chief and Council of the English River First Nation Band of Indians hereby enact a By-law thereof as follows: 1. No boy or girl within the confines of the English River First Nation Band actually or apparently under and including everyone 16 years of age, shall loiter at or near any public place after a. 11:00 p.m. during school holidays and weekends. b. 10:00 p.m. in the afternoon (evening) during school days from Sunday through Thursdays weekly. 2. No boy or girl on the English River First Nation Band actually or apparently 16 years of age and under inclusive shall be in any public place of entertainment unless
accompanied by his/her parent/guardian or an adult appointed by the parent/guardian to accompany said child/youth. 3. Any parent/guardian of the said boy or girl within the confines of the English River First Nation Band who allows, willingly or unwillingly, the child/youth under their care to contravene said by law a. Upon summary conviction will be assessed a fine not-exceeding one thousand dollars or imprisonment for a term not-exceeding thirty days or both or b. With the assistance of the local constabulary and/or the R.C.M.P. will lay a charge to that particular parent/guardian or any such person held responsible for said child/youth 16 years of age and under who willingly or unwillingly allow his/her child/youth to be in a public place within the said English River First Nation Band limits or boundaries: i. Upon the first offence a warning to be issued. ii. Upon the second offence a $50.00 fine to be assessed. iii. With further subsequent offences the fines assessed will double the previous fines. 4. For the purposes of the English River First Nation Curfew By-law: a. "band" refers to the English River First Nations Band situated within the community of Patuanak, Saskatchewan. b. "youth/child", for the purpose of this By-law, are synonymous. It includes all English River First Nation Band members who are and includes 16 years of age and under. c. "public place" includes any land, building, convenience, conveyance, park, playground, highway, road, street or any place to which the public has or is permitted to have access.
