S0E0S0 Liquor By-laws Cumberland House Cree Nation (Cumberland House Band o f Indians) Whereas the primary function o f the Cumberland House Cree Nation is to provide a measure o f self-government; Whereas the regulation and control o f intoxicants is a necessary aspect o f the self-government o f the Cumberland House Reserves; Whereas a majority o f the electors o f the Cumberland House Cree Nation, who attended and voted at a special meeting o f the Cumberland House Band on ^(date) called by the council o f the Cumberland House Cree Nation on aL9 IXfC (date) for the purpose of considering the contents of this by-law, assented to the contents o f this by-law; Whereas section 85*1 of the Indian Act empowers the council o f the Cumberland House Cree Nation to make by-laws regulatin intoxicants on a reserve; Now therefore the Council o f the Cumberland House Cree Nation makes the following by-laws "Prohibition against Intoxication (1) Every person who is intoxicated on the reserves o f the Cumberland House Cree Nation is guilty o f an offence punishable on summary conviction except: (a) where a person is intoxicated in his home, at a campsite,at a place used as a private residence, or at s private dwelling to which he has been invited, or (b) where a person is causing no nuisance or disturbance of the peace, or

SOE 0S0 £ 3 (c ) where the Band Council has issued a permit allowing intoxication in such circumstances# Prohibition on Possession o f Intoxicants (2) Every person who is found in possession o f intoxicants on the reserves o f the Cumberland House Cree Nation is guilty o f an offence punishable on summary conviction except: (a) where possession is for medicinal purposes* or (b) where possession is in his home, at a campsite or at a place used as a private residence or at a private dwelling to which he has been invited, or (c ) where the Band Council has issued a permit allowing the possession o f intoxicants in such circumstances, or (d) where the possession is merely for the purposes o f transportation from one place where i t is lawful to possess i t to another such place#1* Offences (3) Every person who contravenes this by-law is guilty o f an offence and is liab le on summary conviction to a fine o f not more than one hundred dollars or to imprisonment for a term not exceeding three months or to both. Cumberland House Cree Nation (4) Cumberland House Cree Nation means the Cumberland House Band of Indians within the meaning o f the Indian Act.
