BY-LAW NO. A by-law of the Buffalo River Dene Nation to make certain roads on the reserve accessible to the public for the passage of motor vehicles. The Council of the Buffalo River Dene Nation enacts as f o l l o w s : 1 . SHORT TITLE In this by-law, the terms: a) "highway" shall have the same meaning as that term is defined in The Highway Traffic Act of the Province of Saskatchewan* S.S. 1986, c, H-3.1. b) "Motor Vehicle" means a vehicle powered or driven by means other than by muscular power. c) "Reserve" means all that land set aside by Her Majesty the Queen in the Right First Nation, being registered as Peter Pond Reserve No. 193. d) "roads" means: i) every roadway, driveway, street and lane open for passage of motor vehicles (and whether or not actually used by the general public for that purpose) which is marked in red on the map of the Reserve attached hereto as Schedule "A"; and ii) any highway within the Reserve.
3. PURPOSE The purpose of this enactment is to ensure that certain roads on the Reserve are accessible to the public for the passage of motor vehicles and is made pursuant to Section 81(l)(b) of the Indian Act. 4. PUBLIC ROADS Every road marked in red on the map attached hereto as Schedule "A" and situated within the boundaries of the Reserve shall be accessible to any member of the general public for the passage of motor vehicles in the same manner and to the same extent as is any provincial highway. 5 COMPLIANCE WITH LAWS The owner and the driver of every motor vehicle which is upon any road within the Reserve shall comply with all laws and regulations in force from time to time in the Province of Saskatchewan relating to motor vehicles on the basis that every road (as defined herein) within the Reserve is a highway, except such laws or regulations as are inconsistent with the Indian Act of Canada or any regulations made thereto. 6. This bylaw shall come into force and take effect in accordance with the provisions of the Indian Act of Canada.
