TEMAGAMI BAND Q6 BY-LAW 006 Being a by-law respecting Domestic dog control on Bear Island Reserve #1 (amends By-law 005) WHEREAS subsection E of Section 81 of the Indian Act empower the Council of an In t dian Band t o make By-laws respecting the protection against and prevention o f trespass by cattle and other domestic animals, the establishme nt of pounds, the appointment of pound-keepers, the regul ation of their duties and the provision for fees and charges for their services, and the imposition of a fine for violât ion of any by-laws made under that section; AND WHEREAS subsection R stat es: The imposition on summary conviction of a fine not exceed ing one hundred dollars or imprisonment for a term not exceedin g thirty days, or both, for violation of a by-law made under this section. AND WHEREAS the Council of th e Temagami Band of Indians did enact by-law 005 respecting Domestic Dog Control on Bear Island Reserve #1. AND WHEREAS the said Council deems it to be expedient and in the best interest of the residen ts of the Bear Island Reserve to amend the said by-law; NOW THEREFORE the Council of the Temagami Band of Indians enact as a by-law thereof as foHows : D0G_BY-LAW Being a by-law to regulate the keeping and control of dogs on Bear Island; the Licensing and Restrain t of dogs ; the Quar-antinning and Destruction in certain instances. DEFINITIONS Owner: 2/ Owner of Dog must be resident on Bear Island and 18 years of age or older. Dogs (a) SPAYED FEMALE: A Bitch or Female which has been operated upon by a licensed Veterinarian to prevent conception. t (b) DOG: The male dog. (c) BITCH: The female dog not spayed. (d) WORK DOG:, Male dog or spayed female. CONTROL_OFFICER Special Constable, Bear Island, Ontario AT_LARGE Any dog off the property of owner and not under control of competent person. RESTRAINT A dog on his owners property or on leash or under control. (1) All dogs on Bear Island must be registered: By 1979 and registration must be renewed during the month of October every year thereafter. (2) There will be three forms of registration: (a) Male dogs and spayed females (b) Female dogs Cc) Work dogs (3) Cost of registration per dog will be: (a) Male dogs and spayed females $10.00 (b) Female dogs or bitch 20.00 (c) Work dogs 1.00 (4) All dogs will be required to wear a collar with registration tags fastened to it. (5) Tags will not be transferable from one dog to another. (6) New tags can be obtained from registration office for lost tags at a cost of $1.00. (7) When unregistered dogs are found at large by the control officer the owner will be given 7 days to register the dog, or the dog will be destroyed. (8) Dogs registered as work dogs must be kept under restraint at all times, otherwise the $10.00 registration will be enforced. (9) Complaints of cross dogs to be directed to control officer. (10) Dogs that bite are to be tied up for 10 days at owners expense and then destroyed. (11) Dogs that are to be destroyed without owners consent. The control officer must obtain authorization from Band Council. (12) Registration of dogs to be done by Band Office. Where application forms and tags will be available. Applicant must be 18 years of age or older.
