( BY-LAW NUMBER 20 WHEREAS it has been deemed advisable to provide for the formation of Playgrounds and Recreational Commission on the Six Nations Reserve and to establish a Recreation Commission on the said Reserve under Paragraph (M) and Paragraph (Q) of Section 80 of the Indian Act, NOW THEREFORE THE COUNCIL OF THE SIX NATIONS RESERVE, OHSWSKEN, ONTARIO, ENACTS AS FOLLOWS 1, THAT a Committee to be known as the Six Nations Recreation Commission % be set up on the Six Nations Indian Reserve, 2, THAT the said Recreation Commission shall be entrusted with the development of a community programme of recreation within the meaning ( of the regulations under the Department of Education Act, this programme to be a year-round service for all ages and interests in terms of the following:-(a) The maximum use of all recreation facilities and resources in co-operation with other public and private agencies, (b) The recruiting, training and supervision of leadership services for recreation, (c) The maintenance of those municipal recreation activities that meet the expressed needs of the community, (d) To be ready to assist and encourage private, industrial or commercial agencies in providing improved recreation programmes,. 3, THAT said Recreation Commission shall be composed of eight members appointed by the Council, Two of the eight members shall be members of the Council of the Six Nations Indian Reserve and each member of Council shall serve for a period of one year. The remaining six members (at least one of whom shall be a woman) shall be appointed by the Council upon the recommendation of the Six Nations Recreation Commission, The six members so appointed shall serve for a period of three years, with two of such members retiring and two new appointments made annually. A, The Commission shall be authorised and empowered to do the following things, namely \ (a) To prepare a constitution setting forth the aims, objectives, and by-laws of the said Commission,
( (2) (b) To hire, pay and discharge staff and to fix their duties and responsibilities• (c) To purchase, hire, make or provide, and to re-sell or dispose of furniture, furnishings, fixtures, sports, recreational' entertainment and maintenance equipment necessary to achieve the objects of the Commission* (d) To apply for and receive financial assistance from any government or other authority* (e) To control its own separate moneys and to pay its own operating expenses* (f) To enter into contracts in its own name for the ptirpose of its business* (g) To conduct area community programmes of recreation and to appoint area recreation committees and appoint area recreation directors for the operation of approved area programmes. (h) The persons to be appointed as members of area recreation committees shall be selected each year by the interested citizens resident in the areas concerned at properly conducted annual meetings. (i) To print and publish any paper, periodical, book or leaflet it may deem desirable for the promotion of its objects and to advertise its affairs, activities and undertakings by any means that may be thought advisable. « (j) To do all such lawful things as are incidental or conducive to the achievement of its objects. 5. Notwithstanding anything to the contrary hereinbefore contained, all by-laws, rules and regulations of the Commission shall be subject to the approval of the Council of the Six Nations Council. 6. In carrying out the provisions of this By-Law, the Commission shall at all times be the agent of the Six Nations Council and while acting bona fide within the limits of the authority of this by-law, neither the Commission nor any member thereof shall incur any liability by reason of anything done or left undone by the Commission, provided, however, that nothing in this paragraph contained shall authorize or eaDover the Commission to incur any debt, liability or obligation for which the Six Nations Council shall become liable without having pre viously obtained the consent of the Council* 7. To make such agreements through mutual consent with the Fairgrounds. Committee, the School Committee, and other public Boards or Commissions as will provide for the allotment of facilities and scheduling of recreation activities directly supervised by the Commission sponsored by various clubs and organizations.
(3) 8, That the said Recreation Commission shall on or before the 15th day of February in each year prepare its budget for the year and present same to the Finance Committee of the Six Nations Council for its consideration and approval.
