An Iq 75 _ D A Y - JOUR MUT* fH - MOIS Y E A R - AN N E E DO H EREBY RESOLVE: DECIDE, PAR LES PRESENTES: Motion No. 5 Moved by Mr. Franklin Shawbedees, secon ded by Mr. Wilbur Ritchie, that we the Council of the Saugeen Band of Indians at the meeting held the 22nd dav of September 1975, makes the following by-law pursuant to paragraphs (b), (p (<l) and (r) of Section 81 of the Indian Act: A by-law to control the use of snowmobiles on the Saugeen Indian Reserve # 29 and Chiefs Point Indian Reserve # 2B. Definition 1. permit holder means a person who has been issued a permit under this by-law or a person authorized to operate a snowmobile registe- -red under this by-law. snowmobile - means any motorized snow vehicle. •'registration officer" means the person appointed by the Council to be responsible for the issuing of permits and the registration of snowmobiles under this by-law. 2. Except where it is specifically provided otherwise, the provi- -sions of this by-law do not apply to members of the Band. ___ continued...... 2. The Council shall appoint a person to be registration officer, under this by-law. It shall be the responsibility of the registration officer and of the Saugeen Band Police to enforce the terms of this by- -law. 4. No person may operate a snowmobile on the Saugeen Reserve unless (a) he is a permit holder; and (b) the snowmobile has been registered pursuant to this by-law. 5. The permit and the registration shall set out the name and address of the owner of the snowmobile, and the make, model and serial number of the snowmobile. 6. The fee for such registration arid permit may be set by resolution of the Council. 7. Band members using snowmobiles on the reserve shall register their snowmobiles with the registration officer for purposes of identi­ fication. No fee shall be required of band members on registration. 8 . Continued 9# A permit entitles the permri holder to operate the snowmobile registered in the permit within the restricted area set out in this by- -law between the hours of 10:00 a.m. and 10:00 p.m., and in no other part of the reserve and at no other time, 10. A sticker or identification tab in a form prescribed by Council may by required to be affixed on any snowmobile on the reserve, whether owned by a band member or a permit holder, as evidence of registration. 11. All persons, including band members, operating snowmobiles on the reserve, shall stop when requested to do so by the Saugeen Band Police. 12. A person who is not a permit holder and who operates a snowmo- -bil on the reserve is guilty of an offence and is liable on summary conviction (a) on a first offence, to a fine of not less than 5 dollars and not more than 10 dollars; and (b) on any subsequent offence, to prosecution as a trespasser pursuant to Section 30 of the Indian Act; and 12. (c) On a third offence or any subsequent offence, to having the snowmo- -bile seized by the registration officer or the Saugeen Band Police. continued .......4. Any Snowmobile seized under Section 12(c) shall be disposed of in a manner prescribed by the Council. 14. A permit holder who operates a snowmobile outside the prescribed area shall be guilty of an offence and shall be liable on summary con­ viction, the following: (a) on a first offence, to a fine of not more than ten dollars, and (b) on any subsequent offence, to a fine of not more than ten dollars and to the revocation of his permit by the registrata- tion officer. 15. A person who operates a snowmobile at any place on the reserve between the hours of 10:00 a.m. and 10:00 p.m. shall be guilty of an offense and shall be liable on summary conviction to a fine of not less than five dollars($5.00) and not more than ten dollars($10.00). 16. The area within which permit holders are permitted to operate snowmobiles is as follows: (i) That area boardered by Bruce Road 21, French Bay Road and 3rd Ave., South Sauble Beach, Saugeen Indian Reserve # 29» (ii) That area known as Lot 16, Concession "EM, Shore Subdivision, Saugeen Indian Reserve #29* continued .......5 A quorum for th is Band Pour cette bande le quorum est co n s is ts o f fix é à Council Members Membres du Conseil
