PAR LES P R E S E N T E S : ï GRASSY NARROWS FIRST NATION BY-LAW RESPECTING CURFEW BY-LAW NO. 1620 WHEREAS paragraphs 81 (1) (c), (d), (q) and (r) o f the Indian Act, R.S.C, ch. 1 - 5 empowers the Council o f a Band to make by - laws for the observance o f law and order, the prevention o f disorderly conduct, matters ancillary thereto, and penalty for the violation thereof; AND WHEREAS the Council o f Grassy Narrows First Nation o f Indians is o f the opinion that a curfew should be established, for the welfare and safety o f the children and the community on thé reserve; THEREFORE, the council o f the Grassy Narrows First Nation o f Indians enacts a by-law as follows: Short Title 1. This by-law be cited as the drassy Narrows First Nation Curfew By-law Interpretation 2. In this by law: s- -"; U ."-, t W \ ch ild means any person who is e^d^|he age o f 16 years; "community social event means a wétiding, winter carnival, sports event, religious celebration, or other social event recognized as such by the Council o f the Grassy Narrows First Nation parent means a father, mother, tutor, guardian or person having the custody or care in law or in fact of a child:

C-46; prohibited hours means that period of time between the hour o f eleven oclock in the evening o f one day and the hour six oclock in the morning o f the following day during the calendar months o f June, July, August and September o f each year; and between the hour o f ten oclock in the evening of one day and the hour o f six oclock in the morning of the following day during the remaining calendar months o f each year; reserve means the Grassy Narrows First Nation Indian Reserve No. 21 Prohibition 2. No parent shall permit their child to be in any public place during the prohibited hours unless such child: A) is accompanied by his Jparent; B) is accompanied by a person who is eighteen (16) years o f age or over, with the authorization o f that child's parents; C) is attending or is director returiting^iome horn a community social event; or, " $ f D) is authorized by resolutid&pf Council, Powers of the peace officer 3. A peace officer who finds a child who is or, in the absence of evidence to the contrary, appears to be under the age o f 16 years, in a public place during the prohibited hours contraty to section 2 may warn such child to immediately return to the childs residence and, if after so warning, the child refused or neglects to return to this residence forthwith, the peace officer may use such reasonable force as is necessary to escort such to the childs residence.

( 1 ) If, after the warning referred to in section 3 o f this by-law, the warning is disregarded by the child, or if the child is found disobeying this by-law a second time within a period o f thirty (30) days, the parents o f such child may be directed, by resolution o f the Council, to meet and discuss the situation with the Council or anyone appointed by the Council through Band Council Resolution for that purpose. (2) A copy o f the resolution o f the Council referred to in subsection 4( 1 ) shall be sent by first class mail or delivered by hand to the childs parents not less than seven (7) days prior to the proposed meeting.
