LONG LAKE #77 INDIAN RESERVE BY-LAW #5 Being a by-law to regulate traffic on the reserve and to replace by-laws number 1 and 4 enacted 15th of November,1977. WHEREAS under Section 81(b) of the Indian Act R.S., c. 149, Section 1, the Council of a Band is empowered to make by-laws to provide for the regulation of traffic on the reserve. * NOW THEREFORE the Council of the Long Lake #77 Band of Indians enacts as a by-law the following: 1. In this by-law: (a) "Council" means the Council of the Long Lake Band of Indians as defined in the Indian Act. (b) "Police Officer" means any member of the R.C.M.P., Ontario Provincial Police of Band police force who is duly authorized to enforce law on the Reserve. (c) "Reserve" means Long Lake Indian Reserve #77, set apart fot the use of the Long Lake (#77) Band of Indians. (d) "Restricted Zone" means any area of Long Lake Reserve #77 posted by the Band Council as a restricted speed area. (e) "Motorized Vehicle" means any vehicle other than one propelled by the physical effort of the operator, and includes snowmobiles, trucks, automobiles and motorcycles. 2. No person shall operate a motorized vehicle on the Reserve unless he or she is in possession of a valid drivers licence issued by the Province of Ontario, qualifying the person to operate the type and class ofmotor vehicle involved. 3. No person shall operate a motor vehicle on the Reserve unless such person has valid insurance coverage covering public liability and personal injury up to an amount not less than $200,000.00 and in accordance with the insurance requirements of the Province of Ontario for the operation of a motor vehicle on the provincial highway and road networks. 4. The operator of a motorized vehicle will at no time exceed the speed limit posted by Band Council in any restricted zone. 5. A Police Officer may check the speed of any motorized vehicle on the Reserve by means including pursuit, timing over measured distances and radar speed measurement devices or any other means approved by Council.
-2-6. A Police Officer may issue a summons in a form approved v ( by Council to any person violating this by-law. 7. Any person who receives a summons under this by-law shall have the option of acknowledging his guilt and paying the assessed fine to Council within five days of the date of the said, summons or of testing the matter in a Court of law. 8. Any person contravening this by-law is guilty of an.o ffence and on summary conviction is liable to a fine note xceeding $100.00 or imprisonment for a term not exceeding 30 days or both. 9. Notwithstanding the generality of the preceeding paragraph any person found guilty of exceeding the speed limit in a; restricted zone shall be liable to a fine according to the following scale: 1-14 KM over posted limit - $5.00 per KM 16-24 KM over posted limit - $8.00 per KM . 26-32 KM over posted limit - $15.00 per KM an operator who exceeds the posted limit by more than. 20 ^ M.P.H. must appear before a magistrate for sentencing. 10. An operator who is convicted of speeding offences more than six times in a calender year shall be prevented from driving any motorized vehicle on the reserve for a period of six months, and upon infringement of such an order shall be liable on summary conviction to a fine not exceeding $100.00 or imprisonment for a period not exceeding thirty days.or both. WHEREAS under Section 81(c), (d), (q) and (r) of the Indian Act R.S.,c.l49, Section 1, the Council of the Band is empowered to make by-laws. f AND WHEREAS it is considered that control of children on the Reserve is necessary for their own safety. NOW THEREFORE the Council of the Long Lake Band of Indians enacts as a by-lawthereof the following: 1. In this by-law: (a) "Council" means the Council of teh Long Lake Band of Indians as defined in the Indian Act. (b) "Reserve" means Long Lake Indian Reserve #77,set apart for the use *of the Band. (c) "Police Officer" means any member of the R.C.M.P., Ontario Provincial Police of Band police force who is duly authorixed to enforce law on the Reserve. (d) "Child" means a person under the age of eighteen years. 2. No child on the Reserve shall loiter or be in any place within the Reserve after ten o'clock p.m. unless accompanied by his or her parents or an adult appointed by a parent to accompany such child. 3. A child on the Reserve found violating the provisions of- paragraph 2 may be warned and conducted home by a police officer and if the warning is not regarded of after such warning the child is again found disobeying said paragraph 2, the parents of such child shall be directed by a police officer to meet with the Advisory Committee appointed by . the Council for the protection of the children. 4. Any person permitting a child to violate paragraph 2 herein is guilty of an offence and on summary conviction is liable to a fine, not exceeding $100.00 or imprisonment for a term not exceeding thirty days or both.
