Establish and regulate a Fire Department. b. and to establish a Fire Safety Safety Committee. To monitor and assess the progress and function of the Fire Department, Th-ift »flfrLaw to be known as No. 1986-1 In this By-Law, unless vu\ft \ \ 1 Q the contents otherwise requires: i) "Council" means the Council of the Curve Lake Band ii) "Department" means the Fire Department, iii) "Member" means and includes officers and personnel, iv) "Indian Act" means the Indian Act RS. C. 149. 1. v) "Committee" means the Fire Safety Committee. The Fire Department shall be referred to as the Department for the purpose of these regulations. The Department shall consist of one (1) Fire Station, one (1) Fire Chief and one (1) Deputy Fire Chief and three (3) Captains one (1) for each team or station and not less than nine (9) Fire Fighters, the above will constitute the chain of Command for the Department. Fire Safety Committee terms of reference shall be to: a. Monitor and assess the progress and function of the Fire Department. b. Assist in the recruitment and selection process for the Fire Department. c. Ensure that there is implementation of all of the following clauses. d. Provide continuity for the Fire Safety, Fire Prevention Program. e. Provide support and backup services to the Fire Department. f. Make recommendation to the band council (VIA Reports). Every Member of the Department shall: a. be required to pass a medical examination prior to being accepted as firemen; b. be required to pass a medical examination once every year thereafter. Medical examinations will be the expense of the Curvp Le^e Band Councxl; c. be at least eighteen (18) years of age and not more than sixty (60) years of age.

a. The Fire Chief shall be appointed by a resolution, passed in Council, and shall hold office until such time as the said resolution is rescinded. b. The Fire Chief shall require every application for appointment as a Fire Fighter to be in writing on forms to be supplied by the Council. The Fire Chief shall examine every application and forward it to the Fire Safety Committee with his recommendations. All officers and Fire Fighters may be appointed by the Council upon recommendation by the Fire Safety Committee and shall serve a probationary period of not less than -six (6) months before permanent appointment can be considered. The Fire Chief may suspend any member of the Department for the following: a. insubordination b. inefficiency c. gross misconduct d. repeated failure to attend practices or fires. The Fire Chief shall refer such suspension to the Fire Safety Committee, together with his report and recommendation, for such action as it may deem advisable. The annual cost of operating the Department shall be included in the annual budget of the Council, and the Administration Secretary shall notify the secretaty of the Fire Safety Committee who in turn will notify the Fire Chief at least two (2) months prior to the date on which the Council budgets are to be considered. The Fire Safety Committee, in cooperation with the Fire Chief, shall submit to the Finance meeting the annual budge.t necessary for the operation . and maintenance of the Department for the fiscal year. This budget will be submitted in time to be considered with all other Council budgetary items. . The budget, as submitted by the Fire Safety Committee, shall be in the form required by the Council and shall include; a. honoraria and allowances b. fire fighting safety apparel c. office supplies d. Workmens Compensation e. liability and insurance premiums for fire trucks f. the pirchase of new fire vehicles and fire fighting safety equipment g. maintenance and repair to fire vehicles, fire fighting equipment and fire alarm and communications system and equipment h. any other items charged to »':the Department such as: Mutual Aid; Fire. Fighters Association; Training Programs, etc. i. Licenses j. Utilities k. gas and oil
Honorarium and allowances for the officers and fire fighters shall be at the discretion of the Curve Lake Band Council upon recommendation of the Fire Safety Committee. a. The Fire Fighters shall respond *11 fire alarms in each station in area of fire on the Indian Reserve, and attend all scheduled practices and obey all orders and instructions of their officers. b. Curve Lake Fire Department shall respond to any fire calls to a Municipality, or Municipality with which an agreement has been entered into, to provide fire protection on a mutual aid basis. The Fire Chief shall: a. have full responsibility of the conduct and general operation of the Department, including fighting a fire, responding to a fire alarm, drills or pratices, care and maintenance of the Fire Halls and all appartus, equipment and supplies; b. in his absence, put the chain of command mentioned in No. 3 above into action; c. regularly inspect for fire hazards, all manufacturing and mercantile premises, churches, schools, institutions, public buildings and places of assembly, and on request, inspect residences and designate any qualified officer or fire fighter as Fire Prevention Inspector, to assist in such duties; d. maintain a record of every fire call and every fire reported to the Department that occur while on duty, to the administrâtive Secretary of the Curve Lake Band Council and the said secretary to forward a detailed report of such injury on the prescribed form to the Workmenfs Compensation Board. The Department shall meet at least once a month under the supervision of the Fire Chief for practice and instruction in the use of all apparatus, equipment and supplies of the Department and in the principals of fi::e fighting, fire prevention, fire protection and first aid to the injured. A standard training syllabus shall be established using the text books of the International Fire Service Training Association. The Department may: a. Organize for social purposes, events intended to further the interests, welfare and morale; b. Subject to tne approval of the Curve Lake Band Council aave use of the Fire Hall at any convenient time for the :ransaction of business or for social functions.
The officer in charge at any fire may cause any fence or any out structure to be removed or torn down, if such removal or tearing down is necessary to prevent the spread of fire. 1 6. No rule or regulations of any organization shall in any way limit or diminish the authority of the Fire Chief in the performance of his duties. 17, No person shall impede, interfere with or hinder any officer or fire fighter in charge of his duties at a fire, in responding to a fire alarm or at a practice, and no person shall put to any use not authorized by the Fire Chief, an apparatus, equipment and supplies. 18, Any person contravening any provisions of this Resolution shall, upon conviction be liable to a fine or internment or both. 19, In case the provisions to this Resolutions conflict with the provisions of any other Resolutions, the provisions of this Resolution shall prevail. 20 . These regulations or policies shall be subject to change periodically when deemed necessary with the approval of the Band Council.
