215 1 'SO f-i/iY 24 /l10 :,r6 COUCHICHING BYLAW 9 0 - 2 Being a By-Law respecting disorderly conduct and nuisances. Whereas: Sections 81 (d), (q) and (r) of the Indian Act empowers a Council of a Band of Indians to make By-Laws respecting disorderly conduct and nuisances and the imposition of a penalty for the violation thereof: Now therefore: The Council of the Couchiching Band of Indians enacts as a By-Law thereof as follows: In this By-Law, (a) "Council" means the Council as defined in the Indian Act, of the Couchiching Band of Indians; (b) "Reserve" means that tract of land the legal title to which is vested in Her Majesty that has been set apart for the use and benefit of the Couchiching Band of Indians and known as Couchiching Indian Reserve 16A. (1) No person, on reserve land, shall participate in disorderly conduct, meaning unruly behaviour, a breach of civil peace, the use of loud abusive or profane language in such a manner as to disturb the peace within the reserve. (2) No person, on reserve land, shall create a nuisances, deemed as, unusual sound or noise created by any radio, phonograph, television, musical instrument, public address system, sound equipment, loudspeaker or similar device or instrument if played or operated in such volumes as to annoy or disturb the peace, quiet, comfort or repose of any individual in any
- 2 house, apartment house, or any type of residence or abode. (3) No person, on reserve land, shall remove, deface, destroy, damage or mutilate or in any manner whatsoever, vandalize public property on the reserve or attempt to vandalize such property. (4) Any person who violates any provisions of this By-Law shall be guilty of an offense, and shall be liable, on summary conviction, to a fine not exceeding One Hundred Dollars, or imprisonment for a term not exceeding thirty days or to both fine and imprisonment.
