CHIPPEWAS OF MNJIKANING FIRST NATION Being a Band within the meaning of the Indian Act BY-LAW APPOINTING A CHIEF BUILDING OFFICIAL, BUILDING INSPECTOR AND FIRE PREVENTION OFFICERS BY-LAW NO. 06-07 Enacted on the 8th day of August, 2006. WHEREAS the Chippewas of Mnjikaning First Nation recognizes and affirms its inherent right of self-government and jurisdiction to pass laws and powers, and its authority pursuant to the Indian Act to create by-laws providing for the health and safety of the residents on and visitors to the Mnjikaning First Nation Territory; AND WHEREAS it is desirable, in the interest of promoting health, safety and welfare of all members of, employees and visitors to the Chippewas of Mnjikaning First Nation to ensure fire and building safety standards within the community; AND WHEREAS the Chippewas of Mnjikaning First Nation have adopted fire and building safety standards for application within the First Nation Territory, including the 2005 National Building Code o f Canada, the National Fire Code o f Canada 2005, the 1997 Ontario Building Code, and the Ontario Fire Code (O. Reg. 388/97 amended to O. Reg. 650/05) of the Fire Protection and Prevention Act, 1997, S.O., C-4; AND WHEREAS the Chief and Council of Chippewas of Mnjikaning First Nation have enacted the Mnjikaning Fire Rescue Service Establishing and Regulating By-Law No. 06-04 enacted on August 8, 2006; and have also enacted the Land Use and Development By-Law No. 06-01 enacted on March 17, 2006, both of which By-Laws set out the standards noted above; AND WHEREAS the Chief and Council of Chippewas of Mnjikaning First Nation seek to appoint officials and inspectors as are necessary for enforcing these standards within the community; NOW THEREFORE the Chief and Council of the Chippewas of Mnjikaning First Nation hereby enacts as follows: 1. That Mr. Bob Gibson is hereby appointed as Chief Building Official for the Chippewas of Mnjikaning First Nation; 2. That Mr. Dan Stinson is hereby appointed as Building Inspector for the Chippewas of Mnjikaning First Nation; By-Law Appointing A Chief Building Official, Building Inspector And Fire Prevention Officers Page 1 of 3
3. That the following individuals are hereby appointed as Fire Prevention Officers for the Chippewas of Mnjikaning First Nation: a) Mark Pankhurst, Fire Chief b) Elmer Tryon, Fire Prevention Officer c) Mike French, Fire Prevention Officer 4. That the above noted individuals are hereby granted the authority to carry out their respective duties pursuant to Mnjikaning First Nation By-Laws 06-01 and 06-04, and to enforce the appropriate fire and building safety standards set out therein as per the 2005 National Building Code o f Canada, the National Fire Code o f Canada 2005, the 1997 Ontario Building Code, and the Ontario Fire Code. 5. If any section or part of this By-Law is found to be invalid for any reason, such section or part or item shall be deemed to be severable and all other sections or parts of this By-Law shall be deemed to be separate and independent therefrom and to be enacted as such. 6. This By-Law comes into effect the day it is passed by Chief and Council. THIS BY-LAW IS HEREBY made at a duly convened meeting of the Chief and Council of the Chippewas of Mnjikaning First Nation this 8 th day of August, 2006. Being the majority of those members of the Council of the Chippewas of Mnjikaning First Nation present at the aforesaid meeting of Chief and Council. The quorum of Chief and Council is four members.
