' \ ' s œ j i * ~ 27 r e » 7 s' BY-LAW NUMBER 8. A BY-LAW TO REGULATE AND CONTROL MOTORIZED SNOW VEHICLES CN THE CAPE CHOKER INDIAN RESERVE. (1) IN THIS BY-LAW* (a) "MOTORIZED SNOW VEHCILE" means a self propelled vehicle resigned to be driven exclusively on snow or ice, or both. (b) "COUNCIL means the Cape Croker Band Council. (c) "HIGHWAY" means a highway as defined in the Highway Traffic/ Act of Ontario. (2) THE OWNER AND/OR OPERATOR of a Motorized Snow Vehicle who is an non-member of the Cape Croker Indian Reserve, Band No. 27, shall register the serial number of his motorized snow vehicle with the Cape Croker Band Administrator before driving it or causing or permitting it to be driven on the Cape Croker Indian Reserve and shall pay to the Band Administrator a fee for a permit to operate a motorized snow vehicle on the aforesaid Indian Reserve. (3) COUNCIL shall control and set the cost of the aforesaid permits which will be available only between the hours of 9 A.M. forenoon and 4 P.M. in the afternoon Monday through Friday, of each week, at the Cape Croker Band Office. (4) MOTORIZED SNOW VEHICLES; operated by non-band members of the Cape Croker Indian Reserve, will be restricted to and operated only within the boundaries of the Cape Croker Park and will be prohibited from operation elsewhere on the Cape Croker Indian Reserve; including any highways therein or any part or parts thereof; (5) THE OENER OR OPERATOR of a motorized snow vehicle shall upon the request of a Constable or other police officer produce evidence that the motorized snow vehicle is registered with the Band Administrator and will upon request produce a copy of the aforesaid permit. (6) NO PERSON shall drive a motorized snow vehicle on the Cape Croker Indian Reserve unless he is insured under a motor vehicle liability Policy in accordance with The Insurance Act, and the owner of a motorized enow vehicle shall not permit any person to drive the vehicle on the Cape Croker Indian Reserve unless the driver is so insured. (7) THE COUNCIL/AND GR the Band Administrator may refuse to issue permits or authorize such controls over the use of said permits as they may deem proper from time to time. (8) ANY PERSON violating any of the provisions of this by-law shall be subject to a penalty of not more than ($50.00) for the first offence and not more than ($100.00) for each sub-sequent offence, exclusive of costs.
