THE ENOCH INDIAN BAND BYLAW #9 DR / f 9 A ylaw to provide for certain exemptions to the Lord's Day Act, Chapter L-13, Revised Statutes of Canada 1970, as amended (herein­ after referred to as "The Lord's Day Act (Canada)") by authority of The Indian Act, Chapter 1-6, Revised Statutes of Canada 1970, as amended (hereinafter referred to as the "Indian Act") and The Alberta Lord's Day Act, Chapter 221, Revised Statutes of Alberta 1970, as amended (hereinafter referred to as "The Alberta Lord's Day Act"). WHEREAS Section 81 (m) of the Indian Act empowers the council of an Indian band to, inter alia, make bylaws for the control and prohibition of public games, sports, races, athletic contests and other amusements ; AND WHEREAS The Alberta Lord's Day Act authorizes a council, by bylaw, to allow certain activities on Sunday after 1:30 o'clock in the afternoon; AND WHEREAS the Council of the Enoch Band of Indians is desirous of permitting certain lawful activities on Sunday. NOW THEREFORE the Council of the Enoch Band of Indians enacts the following Bylaw: 1. In this Bylaw "Council" means the Council of the Enoch Band of Indians, being the elected body responsible for governance of the Reserve, including the Enoch Village; x "Reserve" means the Stony Plain Indian Reserve k No. 135, in the Province of Alberta. 2. Any person may within the limits of the Reserve and after 1:30 o'clock in the afternoon on a Sunday, but not before such time on a Sunday, provide, engage in or be present at (a) any game, contest, sport, race or lottery scheme licensed pursuant to the Criminal Code, or (b) pari mutuel betting related to any activity set out in Section 2 (à) hereof and permitted pursuant
2 to the Criminal Code, or (c) any exhibition of an educational, artistic or cultural nature, or (d) any theatrical performance, concert, recital, lecture or other performance, or (e) any exhibition of moving pictures. 3. Any person may do or engage any person to do any work, business or labour on a Sunday in connection with any activity allowed pursuant to Section 2 of this Bylaw. 4. Any person who violates any of the provisions of this Bylaw shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding One Hundred Dollars or imprisonment for a term not exceeding Thirty days, or both.
