In this by-law ^ T z o . c) (a) Band" means the Chlppewas o f Kettle and Stony Point Sand o f ladions. (b) "Council" means the Council o f the Band. it ' P (c) "Council Secretary" mans the person appointed by the Council to record the minutes o f the Council meetings; Y i Id) "guide" mans a member o f the Band licenced by the Council for the purpose o f this by-law; (e) "issuer" aeons the person authorized, in writing by the Council to issue permits; ' (f) "permit" means a written permit to hunt on the Reserve; end (9> "Reserve" means the Kettle Point Indian Reserve. 2, No person, other than a merger o f the Band shall hunt within the boundaries o f the Reserve without a permit* 3 . No member o f the Band shall invite or accompany any person who is not a member o f the Band onto the Reserve for the purpose o f hunting unless that person has f ir s t obtained a permit. Permit to bunt may be obtained from the Issuer only on production by the Applicant for such permit o f s valid and subsisting Ontario Provincial Hunting Licinse and a Canada Migratory Came Bird Hunting Permit issued in the Applicants name* 5* Permits may be subject to a fee established from time to time by resolution o f the Council. 6. A ll fees obtained pursuant to this by-law belong to the Band and shall be held in trust for the Band by tbe Council Secretary. 7. (a) Open seasons, bag lim its and a ll matters with respect to the hunting o f migratory birds, not otherwise provided for in this by-law. shall be as set out in the regulations for the Province o f Ontario made under the authority o f tbe Migratory Birds Convention A ct. j (b) Open seasons, bag lim its and a ll matters with respect to hunting game other than migratory birds shall be as provided in the regulations made under the Ontario Game Act for the contiguous provinc lands, but shall not apply to members o f the Bend unless sp ecifica lly provided for in a Band Resolution. 0. Holders o f permits when hunting migratory birds or big game may be accompanied by a guide. 9. A ll Band members before being permitted to act as guides must register with tbe Council who w ill issue free o f charge to oach Band member who registers a licence to guido on the Reserve. Every guide shall abide by any rules and g#8alations set down by the Council for the instruction o f guides and fa ilure to do so ad ll result in the revoking o f the licence to guide. 11. The Chief and Councillors o f the Band, Indian constables and any other person or persons naned by the Council shall be e x -o f f ic io o ff ice r s for the en forcement o f th is by-law. 12. Any o f f ic e r for the enforcement o f th is by-daw shall forthwith seise e l l game protected by this by-law. which (a) is found by him in possession o f any person, other than a member o f the Band, who is not la possession o f a permit: (b) appears to.have been taken by some unlawful means; and shall bring such person and game before a police magistrate, stipendiary magistrate or person appointed by the Governor in Council! to be a Justice o f the peace for offences under the Indian Act. 13. Where a person is convicted o f an offence under this by-law. the convicting court or judge may order that the game, in addition to any penalty imposed, are forfe ited to Her Majesty for the benefit o f liver Band provided, however, that the game ao forfe ited shall be delivered to any person or persons designated by the Council. 14. Any person who violates any o f the provisions o f th is by-law shall on summary conviction bo liab le to a fine not exceeding one hundred dollars or imprison­ ment for a term not exceeding thirty days or both fine and imprisonment.
