f » ' f 77/ THE CHIPPEWAS OF KETTLE POINT BAND OF INDIANS By-law Number 15 Being a by-law to regulate the discharge of firearms WHEREAS section 81 (a), (d), and (r) of the Indian Act empower the Council of an Indian Band to make by-laws in respect to the observance of law and order and the prevention of disorderly conduct and nuisances, and to impose a penalty for the violation thereof; AND WHEREAS the Council of the Kettle Point Band of Indians is of the opinion that the indiscriminate use of air guns and similar devices is a nuisance and may be detrimental to law and order and the safety of the residents of the Reserve; NOW THEREFORE the Council of the Kettle Point Band of Indians enacts as a by-law thereof as follows: 1. In this by-law (a) "Firearms11 includes air gun, anÿ type of rifles or shot guns, air rifles, air pistols, spring guns, pellet guns, B-B guns, and other similar kinds of devices: (b) No person shall have a loaded firearm in or on, or discharge a loaded firearm from, an aircraft or a vehicle; or discharge a firearm from or across a road, used or intended for use by the public for the passage of vehicles. (c) "reserve" means that tract or parcel of land set apart for the use and benefit of the Kettle Point Band of Indians and known as the Kettle Point Indian Reserve #44. 2. No person shall discharge, or attempt to discharge, any air gun within the following defined areas of the reserve; (a) cottage areas-park-church and school grounds - Day Care Centre cemetery and any area dangerous to the general public. 3. No person actually or apparently under the age of sixteen (16) years shall carry, discharge, or attempt to discharge any air gun within the reserve unless accompanied by his parent or other person of or over the age of eighteen years appointed by his parents for that purpose. 2

Any person who violates any of the provisions of this by-law, shall be guilty of an offense, and shall be liable on summary conviction to a fine not exceeding one hundred dollars or imprisonment for a term not exceeding thirty days, or both fine and imprisonment.
