RECREATION AND COMMUNITY CENTRES - Minimum By-Law COUNCIL OF: The Algonquins of Golden Lake By-Law No: Rec 01-88 Being a By-Law to authorize the carrying of a Community Programme of Recreation within the meaning of the regulations under the Ministry of Tourism and Recreation Act 1982, and to provide for the establishment, operation and maintenance of Community Centres pursuant to the Community Recreation Centres Act, R.S.O. 1980 and the regulations made thereunder. 1. The Council of the Algonquins of Golden Lake enacts as follows: (a) Pursuant to Regulations made under the Ministry of Tourism and Recreation Act 1982, a Community Programme of Recreation is hereby established for the residents of the Golden Lake Reserve. (b) Pursuant to the Community Recreation Centres Act, R.S.O. 1980 and the regulations made thereunder, a Community Centre is hereby established for the residents of the Golden Lake Reserve. (c) The said Community Programme of Recreation, and the said Community Centre shall be directed, managed and controlled on behalf of the Council of the Algonquins of Golden Lake committee known as the Golden Lake Makwa Recreation Committee. 2. The Committee shall be appointed by resolution by the Council of the Band as follows: (a) Two (2) members of the Council of the Algonquins of Golden Lake (b) Three (3)____ - residents of the said Golden Lake Reserve who are qualified to be elected as members of Council. 3. The Committee functions and responsibilities are listed in Schedule 'A' and the facilities the committee is responsible for are listed in Schedule B*. 4. In carrying out the provisions of this by-law, the Committee shall at all times be the agent of the Algonquins of Golden Lake Reserve and while acting bona fide within the limits of the authority of this by-law neither the committee nor any member thereof shall incur any liability by reason of anything done or left undone by the Committee; provided however, that nothing in this paragraph contained shall authorize or empower the committee to incur any debt, liability or obligation for which the Algonquins of Golden Lake shall become liable without having previously obtained the consent of the Council of the Algonquins of Golden Lake. 5. That the provisions of any by-law that contravene this by-law be and is/are hereby repealed. 6. This by-law come into force and effect on the date its final passing subject to the approval of the Ministry of Tourism and Recreation. SCHEDULE 'A* "This is Schedule 'A' to by-law Rec, No# 01-88 passed this O 2 - day of ___. ADMINISTRATION 1. Subject to the approval of Council, the said Committee shall formulate policies, rules and regulations for and relating to the administration of community programmes of recreation* 2. At any meeting of the said Committee a quorum shall consist of a simple majority of members. 3. The said Committee shall elect a chairman annually from among the members of such other officers as may be required. 4. The said Committee shall submit to Council an annual report of its activities and such other reports as may be required from time to t ime. . 5. The said Committee is authorized to work jointly with other Golden Lake Band services in establishing, operating and maintaining a supervised public recreation system of facilities and activities. FINANCE 1. Annually the said Committee shall submit and interpret to the Council of the Band a budget of its approval and shall make to the Council full and complete annual and other reports as required. 2. The Council through the Band Secretary shall establish separate records on behalf of the said Committee to be known as the MRecreation Financial Records". (a) The signing officers for any financial transactions shall be the signing officers of the Golden Lake Makwa Recreation Committee as appointed each year. (b) The books and accounts of the said Committee shall be kept by the Secretary of the Committee. (c) Subject to prior approval of Council for an approved project, the said Committee may on behalf of Council solicit or receive any gifts or bequests of money and services, to be applied in furtherance of the community programme of recreation. (d) Subject to prior approval of Council for an approved project the said Committee may on behalf of Council solicit or receive any gifts or bequests of money or services of any donations to be applied principal or income for either the temporary or permanent use for facilities, equipment, programme or other recreation purpose. 3. No debt or obligation shall be incurred by the said Committee and no payments shall be made by or on behalf of the said committee unless duly authorized by resolution of the Council. ADMINISTRATION OF FUNDS Note that Section 81 and 82, Chapter 302 of the Municipal Act R.S.O. 1980 states that the Treasurer of the Committee shall receive and safely keep all money of the Committee.
ADDITIONAL CLAUSES FOR SCHEDULE 'A' PROGRAMME AND FACILITIES PROGRAMME 1. The said Committee shall conduct or encourage and assist the programmes of recreation which will meet the needs and interests of the inhabitants of the Golden Lake Band. Such programmes shall include the social, cultural and physical aspects of recreation to each age group, both male and female. STAFF 1. The said Committee may recommend to the Band Council the appointment and discharge of a Director and/or such other personnel as it may be deem necessary to conduct the community programme of recreation and to fix the powers, duties and responsibilities of the persons so appointed. The said persons shall be employees of the Band participating in the privileges as designated in the terms of employment. PUBLIC RELATIONS 1. The said Committee shall at all times keep the inhabitants of the Golden Lake Reserve aware of the recreation opportunities which are available and will continually interpret to the public the total community programme of recreation.
