96 -0 2 0 FILE.: 9 6 0 KAM LO O PS INDIAN BAND COUNCIL RESOLUTION DATE APPROVED AT CO U N C IL MEETING: MARCH 6, 1996 DISTRICT: CENTRAL PROVINCE: BRITISH COLUMBIA PLACE OF APPROVAL: KAMLOOPS QUORUM: FIVE The Kamloops Indian Band Council does hereby resolve that: WHEREAS section 8 1, paragraph (1), and (r), of the Indian Act empower the Council of the Kamloops Band of Indians to make by-laws regarding the construction and regulation of the use of public wells, cisterns, reservoirs and other water supplies. AND WHEREAS the Council of the Kamloops Indian Band did enact by-law number 1995-004 respecting the Kamloops Indian Band Lands Mount Paul Industrial Park Water Works. AND WHEREAS the said Council deems it to be necessary and in the best interest of the Kamloops Indian Band to amend the said by-law. NOW THEREFORE the Council of the Kamloops Indian Band enacts as a by-law therefore as follows: 1. Subsection 29(a) of By-law No. 1995 -004 and the same is hereby amended by adding after paragraph (b), a new paragraph (c) so that the said section now read: General 29. (a) Any authorized agent of the Band to enforce this by-law shall have free access to all parts of every building in which water is delivered and consumed after reasonable notice has been given and request made. He may make personal inspection of all pipes, taps, and related fixtures used for distributing water, if defects are found, or if any wastage of water is found to exist, then a notice will be given to have the defect remedied at the expense of the customer within a reasonable time frame. (b) If any defect or defects of which notice is given shall not be remedied within the time limit specified by the Band Administrator, he shall have authority to cut off the supply of water from the main until such time that the said defect or defects are repaired. (c) During the hours of 6:00 a.m. to 6:00 p.m. daily from Monday to Friday.
