SECHELT BAND OF INDIANS By-Law No. 1983 - 01 A By-Law to Amend the Sechelt Indian Band Animal Control By-Law 1982-03. WHEREAS the Council of the Sechelt Band of Indians passed By-Law No. 1982-03 on the 22nd day of December, 1982, providing for the taxation, control and destruction of dogs and other animals on the Reserves of the Sechelt Band of Indians; AND WHEREAS the Council of the Sechelt Band of Indians deems it expedient to amend such By-Law for the better control of dogs and other animals on the Reserves of the Sechelt Band of Indians: NOW THEREFORE the Council of the Sechelt Band of Indians in open meet­ ing assembled enacts as follows : 1. By-law No. 1982-03 of the Sechelt Band of Indians passed on the 22nd day of December, 1982, cited as the "Sechelt Indian Band Animal Control By-law 1982-03", is hereby amended as follows: (a) By deleting paragraph 9 thereof and substituting the, following: "9. During the period of its detention in the pound, every impounded Dog shall be supplied with a sufficient quantity of food and water. If such Dog is not claimed within three (3) days

WHEREAS the Council of the Sechelt Band of Indians passed By-Law No. 1982-03 on the 22nd day of December, 1982, providing for the taxation, control and destruction of dogs and other animals on the Reserves of the Sechelt Band of Indians; AND WHEREAS the Council of the Sechelt Band of Indians deems it expedient to amend such By-Law for the better control of dogs and other animals on the Reserves of the Sechelt Band of Indians; NOW THEREFORE the Council of the Sechelt Band of Indians in open meet­ ing assembled enacts as follows : 1. By-law No. 1982-03 of the Sechelt Band of Indians passed on the 22nd day of December, 1982, cited as the "Sechelt Indian Band Animal Control By-law 1982-03", is hereby amended as follows: (a) By deleting paragraph 9 thereof and substituting the following: "9. During the period of its detention in the pound, every impounded Dog shall be supplied with a sufficient quantity of food and water. If such Dog is not claimed within three (3) days
2 of its being impounded and if the Dog impounded * has attached to it a metal tag for the current year as hereinbefore provided, the Control Officer shall notify the Owner of Record of his intention to destroy the impounded Dog, or to sell the same to any person by auction or pri­ vate sale, and to retain the proceeds of such sale unless the Owner of Record claims the im­ pounded Dog with seven (7) days of receiving such notification from the Control Officer. If such impounded Dog does not have attached to it a metal tag for the current year, the Control Officer shall make reasonable efforts to ascer­ tain its owner and, if successful, shall notify such owner of his intention to destroy such Dog, or to sell the same to any person by auction or private sale, and to retain the proceeds of such sale unless the owner claims the impounded Dog with seven (7) days of receiving such notifica­ tion from the Control Officer. If such impound­ ed Dog does not have attached to it a metal tag for the current year and if the Control Officer cannot ascertain its owner despite having made reasonable efforts to do so, the Control Officer may destroy such Dog or sell the same to any person by auction or private sale, and retain the proceeds of such sale." (b) By deleting paragraph 11 thereof and substituting the following: "The owner of any Dog which has been seized and released or seized and destroyed shall be liable for all fees pertaining thereto as set out in Schedule "A" or for such fees as may be pre­ scribed by the Sunshine Coast Animal Shelter, or any other animal shelter designated by Band Council Resolution to impound animals pursuant to this By-law."
