BY-LAWS BY-LAW NO: 1992.3 OF THE QUATSINO INDIAN BAND A BY-LAW FOR THE CONTROL OF VEHICULAR TRAFFIC WHEREAS the Council of the Quatsino Indian Band desires to make a By-law governing the control of vehicular traffic, with respect to any matter arising out of or ancillary to exercise the powers under section 81, and for the imposition of a penalty for a violation there of; AND WHEREAS the Council of the Quatsino Indian Band is empowered to make such a By-law pursuant to Section 81(1)(b), (q), and (r) of the Indian Act. AND WHEREAS it is considered to be expedient and necessary for the benefit, comfort and safety of the inhabitants of the Quatsino Indian Band to provide for the control of vehicular traffic on the reserve; NOW THEREFORE the Quatsino Indian Band hereby makes the following By-law: SHORT TITLE: 1. This By-law may be cited as the "Quatsino Reserve Traffic Control By-law". INTERPRETATION: 2. In this By-law, "Band" means the Quatsino Indian Band; "Council" means the Council of the Quatsino Indian Band. "Officer" means any police officer, police constable, member of the Royal Canadian Mounted Police or other person appointed by the Council for the purpose of maintaining law and order on the reserve. "Person" includes a corporation. "Reserve" means the reserves of the Quatsino Indian Band and includes Quatsino Reserve No. 18. "Vehicle" means a device in, on or by which a person or thing is or may be transported or drawn on a highway, except a device designed to be moved by human power or used exclusively on stationary rails or tracks.
2 ( APPLICATION 3. This By-law shall apply to all persons entering Reserve lands in control of a motorized vehicle, or mechanically driven device as defined within the provisions of the MOTOR VEHICLE ACT, R.S.B.C. 1979. and MOTOR VEHICLE ACT REGULATIONS, R.S.B.C. 4. For the purposes of traffic control and Law Enforcement, all roads on Quatsino Reserve are deemed public roads. SPEED LIMIT 5. The speed limit within Reserve Lands under the Administration of the Quatsino Band Council shall be twenty (20) kilometres per hour, or as established from time to time. RIGHT OF WAY * 6. All vehicular traffic shall abide by established traffic control Right of Way principles as established by the Ministry of Transport of Canada, and where further clarity is required, in the MOTOR VEHICLE ACT R.S.B.C. This By-law is hereby made at a duly convened meeting of the Council of the Quatsino Indian Band this <jay 0f iS&.çA __/ 1993. Voting in favour of the By-law are the following members of the Council:
