t BY - LAW NO. 1 MOOSOMIN RESERVE To create the position of a Band Administrator, WHEREAS it is necessary to appoint a Band Administrator to interpret and promote the enforcement of all Band promoted programs and By-laws and to carry out such other duties as may be assigned by Council, THEREFORE, the Council of the Moosomin Band ENACTS AS FOLLOWS: 1. That the position of Band Administrator is hereby created for the Moosomin Band; 2. That the position shall be filled by competition advertised in accordance with policy of Band Council expressed by Resolution; 3. That the incumbent of the said position shall hold office during the pleasure of and subject to the By-laws of the Band Council; 4. That the incumbent of the said position shall be placed on probation for a period of 6 months subject to Band Council recommendations. 5. That the said incumbent shall, upon appointment, file with the Band Council an indemnity bond in a sum adequate to ensure protection on monies entrusted to his case and Trust Account issued by a recognized bonding company; subject to the premium of such bond being paid from the Administration Funds of the Moosomin Band; 6. That the said incumbent shall be paid a salary of $9,100.00 per annum on a semi-monthly basis and such salary may be adjusted by Band Council Resolution according to. the increase or decrease of responsibility of the position and that this shall be on the basis of a 40-hour week; 7. That the salary of the said incumbent shall be payment in full for all services required of him and all fees or emoluments of any kind accruing to him by virtue of any Act or Statute of the Federal or Provincial Government of any By-laws of the Band shall be paid to the Moosomin Band and credited to the finds of the Band; 8. That the duties of the Band Administrator shall, under the general direction of the Band Council and subject to its policies and regulations, be as follows: a) File before taking over his duties as Band Administrator an Oath of Office and Secrecy on Form R.P.l; b) Attend all regular and special meetings of Council and to truly record, in a book authorized for this purpose, without note or comment, all Resolutions, decisions and other proceedings of the Band Council; c) Record the names of all Council members present and the name and vote of every member of Council voting on any matter or question and ensure duplication of forms, circulars, minutes, by-laws, regulations and distribution made according to established practice; d) Keep in his office or in the place appointed for this purpose, the originals of all by-laws and of all minutes of the proceedings of the Band Council by maintaining an offige filing system and index, obtaining, recording and distributing files and other records; % e) Maintain or cause to be maintained an adequate bookkeeping system showing all receipts and expenditures during each fiscal year of all monies transacted in connection with the business of the Band in accordance with the Band Council and Financial Regulations. f) 1) Keep accounts of the Band by coding in keeping with financial regulations, commitments and expenditures, code and record a3 required,
- 2 -2) Post entries related to the collection and expenditure of funds, accounts receivable, budgetary control, loans, balances, deposits and other similar bookeeping work. 3) Check and code invoices, proposed expenditures and compile pay-lists. 4) Extract statistical date from reports or records, making simple calculations, and compiling reports in a prescribed form. f) Keep and ensure that all records, accounts and correspondence acted upon by the Band Council, are preserved and filed; g) Perform or supervise general office clerical duties; 1) Receive inquiries by telephone and at the reception counter making appointments when necessary, and answering routine questions. 2) Receive, open, sort, date stamp, record and distribute incoming mail, and sort, stamp and post outgoing mail; h) l) Maintain records of all employees and time-sheets and ensure paylists are made up and pay-cheques issued. Issue all cheques that are made on Band funds and Band Trust Account; and ensure they are signed by authorized officials; 2) Complete forms and keep attendance, leave and pay-records for casual or hourly-rated employees; i) Ensure an audit of the book is carried out within sixty days after the close of each fiscal year by an audit firm appointed by the Band Council and Indian Affairs Branch as required; j) Acquaint himself with all by-laws of the Band and ensure that they are carried out and to bring to the attention of Council, any case where a by-law is inadequate or being improperly enforced; k) Operate various types of office equipment and machines such as typewriters, calculators and duplicators; l) Maintain an inventory of office stationery, supplies and equipment, record the issue of same, and prepare purchase orders for the replacement; m) Maintain records related to: leases, loans and band projects; n) Acquaint himself with all provisions of the Indian Act and any other Act of the Federal and Provincial Governments that bear upon the well-being of the Moosomin Band or any member thereof; o) Supervise directly any office support staff and provide administrative super­ vision to other Band employees by keeping them informed on the financial circumstances of the programs and reports to Council on any problem foreseen in completing projects within assigned budgets; p) Perform such other duties as may be necessary for the conduct of Band Affairs or as assigned to him by Resolution of the Band Council.
