PROPHET RIVER INDIAN BAND BY-LAW NUMBER 02 - 1987 A BY-LAW TO REPEAL BY-LAW NUMBER 01-85 BEING AN INTOXICANT BY-LAW WHEREAS the Council of the Prophet River Indian Band did enact By-Law Number 01-85 on December 28th, 1985, pursuant to section 85.1 of the Indian Act, to protect its residents from the presence of intoxicants on its reserve lands; AND WHEREAS although this By-Law was properly enacted and registered, it was never published in the Canada Gazette, nor was it exempted from publication; and as a result of this, the Band is prevented from obtaining convictions for breaches thereof that occurred since registration of this By-Law. It is the opinion of the Band Council of the Prophet River Indian Band that our By-Law No. 01-85 is there fore unenforceable; NCW THEREFORE the Council of the Prophet River Indian Band enacts as By-Law thereof the following: 1. By-Law number 01-85 enacted on December 28th, 1985 and being an intoxicants By-Law be and the same is hereby repealed. Approved and passed at a duly convened meeting of the Council of the Prophet River Indian B and held o n ________ JANUARY _____ 25th AND THAT this By-law, prior to enactment by the Band Council of the Prophet River Indian Band, was first assented to by a majority of the electors of the Band who voted at a special meeting of the Band held on JANUARY 25th _______ , 1987 and called by the Council of the Band for the purpose of considering this By-Law. BE IT KNOWN THAT this By-Law shall be known as the "Intoxicants Repealing By-Law" and is consented to by the following members of the Band Council: "Liza Wolf" _______ "Les Forbes" Chief Liza Wolf Witness "Loretta Chipesia"______ _______ "Les Forbes" Councillor Loretta Chipesia Witness "Lorraine Wolf"_______ "Les Forbes" Councillor Lorraine Wolf Witness AND being a majority (or more) of those members of the Council of the Prophet River Indian Band present at the above-mentioned meeting.
