BAND COUNCIL RESOLUTION THE COUNCIL OF THE: OKANAGAN AGENCY: KOOTENAY - OKANAGAN PROVINCE: BRITISH COLUMBIA PLACE: BAND OFFICE DATE: 20th day July Month AD 1976 DO HEREBY RESOLVE THAT: THAT OKANAGAN INDIAN BAND By-Law Number (4) Four Being a by-law for the regulation of the use of Recreational and Off-Highway vehicles within Okanagan Indian Reserve(s) - Okanagan Indian Reserve # 1 - Priest Valley Indian Reserve # 6 - Harris Indian Reserve # 3 - Duck Lake Indian Reserve # 7 Whereas the Council of the Okanagan Indian Band has received numerous requests from the residents of the Okanagan Indian Reserves to establish such regulations and deems it to be in the best interests of the residents of the said reserve(s) to grant the requests; Now Therefore the Council of the Okanagan Band of Indians enacts as a by-law thereof as follows: 1. In this by-law, unless the context otherwise requires: (a) "Highway", "Motorcycle" and "Motor Vehicle" shall each mean the same as "highway", "motor vehicle", and "motorcycle" in the Motor Vehicle Act R.S.B.C. 1960 Chapter 3. (b) "All terrain vehicle" shall mean the same as "all terrain vehicle" in the All Terrain Vehicles Act R.S.B.C. 1971, Chapter 3. (c) "Off-highway vehicle means any type of vehicle propelled by motorized power and capable of travel
on or off a highway and without limiting the generality of the foregoing, shall be deemed to include motorcycle, motorvehicle and all terrain vehicles. 2. No person shall operate or authorize or permit any other person to operate any off highway vehicle within the boundaries of Okanagan Indian Reserves -- Okanagan Indian Reserve # 1 - Harris Indian Reserve # 3 - Priest Valley Indian Reserve # 6 - Duck Lake Indian Reserve # 7 3. Any person who violates any provision of this by-law shall be guilty of an infraction of this by-law and liable to a fine or penalty not exceeding Five Hundred ($500.00) Dollars for each offense. Read a first time this 6th day of July 1976. Read a second time this 13th day of July 1976. Read a third time and finally passed this 20th day of July 1976.
