WHEREAS paragraph (e) and (r) of section 81 of the Indian Act empower the Council of a Band to make by-laws respecting the control of animals and the imposition of a penalty for the violation thereof; AND WHEREAS it is deemed to be expedient for the welfare of the inhabitants of the Kincolith I.R.#14 to license and regulate animals; NOW THEREFORE the Council of the Kincolith Band of Indians enacts as a by-law thereof the following: 1. Each household will be allowed to own one dog, and one dog only. 2. The head of each family, and each person living alone, desiring to keep a dog shall apply to the Kincolith Band Council, and shall obtain a permit for such dog upon payment of a tax, the amount of which shall be established by the Council of the Band; such permit shall be at the discretion of the Kincolith Band Council. 3(a) The Kincolith Band Council shall keep a book,for the registration of all dogs upon the reserve, which registration shall show the name of the owner, the sex, and description of the dog; the tax payable shall be collected at the time of the registration. (b) Upon registration, the Kincolith Band Council shall issue a registration tag, which shall be attached to the dog at all times; any change of ownership of any registered dog shall be entered in the register. 4(a) Tax in the amount of $60.00 (dollars) shall be charged and collected each calendar year for each female dog. (b) Tax in the amount of $40.00 (dollars) shall be charged and collected each calendar year fQr each male dog.
5. When a dog has been born on any date or brought into the village, then the owner should have to pay for registration. 6. No owner of a dog shall leave the said dog unattended on the reserve when the owner temporarily leaves the reserve. 7. If a dog wants to do any harm or damages to any person, or any other registered dogs, then the owner would be liable for the dog's actions, or the animal would be put to sleep. 8. Any dog that has not been claimed would have to be sent down to the SPCA, with the cost of the owner's expense. (Provide notification that the dog is to be sent to SPCA by letter). 9. If a dog has been mistreated or brutilized by the owner, or anybody, then this person should be penalized for their actions under the section code animal brutality. 10. Any person in possession of a dog or dogs that have not been registered and own no dog tag shall have caused an offence against this by-law, and shall be responsible for the destruction of that dog, and shall be liable on summary conviction to a fine not exceeding $100.00 , or if the dog was to cause any damages done to the registered dog then the charges would be liable of summary conviction to a fine not exceeding $500.00 depending of the damages, or imprisonment for a term not exceeding_____days, or both fine and imprisonment.
