NUISANCE BY LAW OF THE MUSQUEAM INDIAN BAND The Council of the Musqueam Indian Band make the f I o n l d l i o an w in A g ct . by-law pursuant to Section 81 (1)(d)(q) of the 1. Interpretation t a. "Nuisances" mean: (i) A motor vehicle or boat or any part of a motor vehicle or boat which is located on any part of the Reserve other than a back yard and which is not currently being used for providing transportation; (i ( i i i i ) ) a d b i a s n o d r o d n e e r d l y ho p u ar s t e i h e o s l ; d appliances and furniture; (iv) any circumstance that unreasonably lessens the comfort 6r endangers the health or safety of the residents of the Reserve. e. "Reserve" means all the reserves of the Band wherever situated. 2. Nuisances on the Reserve A person commits an offence where he or she fails to abate a nuisance on the Reserve after he or she has been notified by the Administrator or a member of the Band Council to do so by a notice of 48 hours or such shorter period as may be reasonable in the circumstances. 3. Punishment for Offences Anyone who violates any provision of this By-law by committing an offence shall be liable on summary conviction to a fine not exceeding ONE THOUSAND DOLLARS ($1,000) or imprisonment for a term of not exceeding thirty (30) days or both.
4. Abatement of Nuisances If a person fails to comply within 48 hours with a notification by the Administrator or a member of the Band Council to abate a nuisance under Section 2 the Administrator or a member of the Band Council may take all steps reasonable to abate the nuisance including towing a vehicle to an automobile wrecker for disposal. The Band, the Band Council and the Administrator shall not be liable to any person for any action taken under this Section. This by-law shall come into force on the date determined pursuant to section 82 of the Indian Act.
