LEGAL CODE of the MUSQUEAM NATION CHAPTER CH-2 CHILDREN’S CURFEW BYLAW AMENDMENT BYLAW WHEREAS: At a General Band Meeting of the members of the Musqueam Indian Band concerns were expressed about the welfare of boys and girls living on Musqueam Indian Reserve Number 2; and, At a General Band Meeting of the members of the Musqueam Indian Band, Chief and Council were requested to take such measures as would insure that the welfare of boys and girls would be promoted by prohibiting the loitering of boys and girls during evening hours; and, The Musqueam Indian Band deems it advisable and necessary to enact a by-law to provide for the regulation of the activities of boys and girls on the Musqueam Indian Reserve Number 2; and, The Council of the Musqueam Indian Band did enact the Children’s Curfew Bylaw, Chapter CH-1, on the 19th day of July, 1993; and, The Council of the Musqueam Indian Band deems it expedient and in the best interests of those persons residing on Musqueam Indian Reserve lands to amend the said Bylaw. NOW THEREFORE BE AND IT IS HEREBY RESOLVED: The following bylaw be and is hereby enacted for the purpose of providing regulation of the activities of boys and girls on Musqueam Indian Reserve Number 2, pursuant to the provisions of the Indian Act, R.S.C. 1985, c. 1-5, and in particular to the provisions of section 81 (1) of the Indian Act, R.S.C. 1985, c. 1-5. 1. Subsection 1 (e) of the CHILDREN’S CURFEW BYLAW, Chapter CH-1 and the same is hereby amended by adding after paragraph (d), a new paragraph (e) so that the said paragraph (e) shall now read: (e) ’’parent” includes the father, mother or guardian of a child or any other person having lawful authority over a child. 2. Clause 8 of the CHILDREN’S CURFEW BYLAW, Chapter CH-1 and the same is hereby amended by adding after Clause 7 a new Clause 8 clause so that the said Clause 8 shall now read: 8. If circumstances prevent a child found in violation of this by-law from being returned immediately to the care of the parents, guardians, or other persons having lawful authority over the child, then, pending notification of the parents, guardians, or other persons having lawful authority over the child, the police officer, by-law enforcement officer, or such other persons as maybe lawfully authorized to do so, shall arrange such temporary accommodations, including but not limited to arranging for the care and accommodation of the child by the Musqueam Safe Home, as may be necessary to provide proper care for the child pending notification of the parents, guardians, or other persons having lawful authority over the child. As soon as it is possible to do so, the police officer, by-law enforcement officer, or such other persons as may be lawfully authorized to do so, shall notify the parents, guardians, or other persons having lawful authority over the child that temporary care and accommodation is being provided to the child and shall make such arrangements as may be appropriate and necessary to return the child to the care of the parents, guardians, or other persons having lawful authority over the child.
