THE KITASOO BAND OF INDIANS By-law 5.74 Being a by-law to provide for the regulation of the activities of children WHEREAS paragraph (c), (d), (q), and (r) of Section 81 of the Indian Act empower the Council of a Band to make by-laws respecting the observances of law and order, the prevention of disorderly conduct, and the imposition of a penalty for the violation thereof; A f N o D r W t H h E e R E g A e S n er i a t l i w s el d f e a e r me e d of e xp th e e d ie i n n t h ab NOW THEREFORE the Council of the Kitasoo Band of Indians enacts as a by-law thereof the following: 1. In this by-law, (a) "Council" means the Council, as defined in the Indian Act, of the Kitasoo Band of Indians; (b) "Reserve11 means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Kitasoo Band of Indians known as Kitasoo Reserve Number One; (c) "child" means any boy or girl actually or apparently under sixteen years of age; (d) "night" means the daily period of time from ten o clock in the afternoon to six o clock in the morning during the months of May through October inclusive; and the daily period of time from nine o fclock in the afternoon to six o clock In the morning during the remainder of the year. 2. No child shall loiter any place within the Reserve at night. 3 - No child shall be in any place of entertainment, street, land, by-way or common within the Reserve, or shall be in the course of returning from any place of entertainment off the Reserve at night, unless accompanied by his or her parent or an adult appointed by a parent to accompany such child. 4. A child found violating the provisions of this by-law may be warned and conducted home by a police officer, or other such official as appointed by a resolution of Council. 5. A parent who permits his or her child to violate this by-law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty dollars or imprison­ ment for a term not exceeding two days, or both fine and imprisonment.
