CHIPPEWAS OF SARNIA BAND COUNCIL CHIPPEWAS OF SARNIA BAND #45 BY-LAW NO. 45 - 91 - 02 Copy "a b y-l a w respecting f i r e a r m s" Being a By-Law to regulate the discharge of Firearms in the confines of the CHIPPEWAS OF SARNIA RESERVE #45. WHEREAS Section 81, Subsection (c), (d), (r) of the Indian Act (1985 c.27) as amended empowers Band Councils to make By-Laws for the observance of Law and Order. AND WHEREAS the Council of the CHIPPEWAS OF SARNIA RESERVE #45 is in the opinion that the indiscriminate use of Firearms and similar devices is a nuisance and maybe detrimental to law, order and safety of the Residents of the CHIPPEWAS OF SARNIA RESERVE U45. PART 1 - GENERAL - DEFINITIONS 1. For the purpose of the By-Law: a). "Firearms" include Air Gun, Any type of Rifles or Shotguns, Air Rifles, Air Pistols, Spring Guns, B-B Guns, Cross Bows and any other similar kind of Devices. PART 2 - DISCHARGE OF FIREARMS 1. No person shall have a loaded firearm in an Aircraft or a Vehicle. 2. No person shall discharge a loaded firearm from an Aircraft or a Vehicle. 3. No person shall discharge a Firearm from across a road which is used or intended for use by the public for the passage of vehicles. j* / 2

No person shall discharge, or attempt to discharge any Firearms as defined in PART 1 of this By-Law: i) Residential Areas ii) Park Areas iii ) Church Areas iv) Pre-Kindergarten or Day Care Areas v) Cemetery Area vi) Industrial Park area vii ) Any area which is in general use by the Public or may be designated by the Band Council. PART 3 - AGE RESTRICTIONS 1. No person actually or apparently under the age of sixteen years shall carry, discharge or attempt to discharge any firearms as defined in PART 1 (Definitions) within the Reserve unless accompanied by his/her parent or other person over the age of eighteen (18) years, appointed by his/her parents for that purpose. PART 4 - PENALTY 1. Any person who violates any of the provisions of this By-Law shall be guilty of an offence, and shall be liable on Summary Conviction to a fine not exceeding $1,000.00 or to imprisonment for a term not exceeding Thirty (30) days or both fine and imprisonment. This By-Law shall come into force and be effective upon it being passed by the Council and/or the members of the CHIPPEWAS OF SARNIA RESERVE #45. PART 5 - AMENDMENTS 1 .
