nr i\ 1 1 an iO INO .U U b K , Ub NXMPKISH BAND BY LAW The Council of the Nimpkish First Nation passed the following By-Law No.19 at a meeting held October 25,1982 and at a meeting held April 8, 1994 amended By-Law No.19 to read as follows: BY LAW No. 19 A By-Law to provide for the regulation of the conduct and activities of hawkers,peddlars or others who enter into or are members of the Nimpkish Indian Reserves in the Province of British Columbia to buy sell or otherwise deal in wares, services,or merchandise and the charging of a license fee therefor. 1. This By-Law may cited for all purposes as "the Band Business By-Law No.19". 2. In this By-Law, unless the context otherwise requires, "Council" means the Council of the Nimpkish First Nation. 3. Hawkers, peddlars, Band members, and others carrying on potty trades, or who otherwise deal in wares or merchadise, who go from place to place or to Band members houses on foot or with any animal or bicycle, automobile or other vehicle bearing, offering, or drawing any goods, services, wares, or merchandise for sale shall before doing business within a reserve take out a license from the Nimpkish Band Office and pay a fee as prescribed by Band Council, which license shall not be transferable and shall expire at the end of the calendar year and may be renewed from year to year upon payment of the required fee. The terms "hawkers and peddlars,and others" shall in addition, extend to and include transient person who solicit or takes orders for hardware, groceries, drygoods, proprietary medicines, small goods or enlarged potographs from a customer for future delivery. continued...

Council may refuse to issue or suspend a license if, in the opinion of Council, such goods, services, wares, or merchandise is not in the best interests of the Band. 5. The applicant for a license may, within 10 days of a notice of refusal to issue or a notice of suspension of a license, appeal to the to the General Membership of the Band at General Meeting of the Band called for the purpose of hearing the appeal, by delivering a notice in writing to the Band Membership Clerk stating his/her intention to appeal and the grounds for the appeal. 6. Every person who contravenes or violates any of the provisions of this By-Law or any permit issued pursuant hereto,or who suffers or permits any act or thing to be done in contravention of this By-Law or any permit issued pursuant hereto or who neglects to or refrains from doing anything required to be done by any of the provisions of this By-Law or any permit issued pursuant hereto, commits an offence and, upon summary conviction therefore, shall be liable to a fine of not less than $100.00 and not more than the maximum fine provided by Section 81(r) of the Indian Aet and where the offence is a continuing one, each day that the offence is continued shall constitute a separate offence.
