1 THE BELLA BELLA BAND COUNCIL-By-Law No. 15.76 Being by-law to amend By-Law No. 14.76 to regulate the time or times during each day during which children shall not be on the streets without proper guardianship, and the age or apparent age under which they shall be required to be in th e i r homes a t the ' our appoi nted. WHEREAS paragraph ( c ) , ( d ) , (q ) and ( r ) , o f section 81 o f the Indian Act empower the Council o f a Band to make by-laws respecting the observances o f Law and Order, the pre vention o f d isorder ly conduct, and the imposition o f a penalty f o r the v i o l a t i o n th e reo f ; AND WHEREAS i t is deemed expedient to regulate the a c t i v i t i e s o f the ch i ldren f o r the general wel fare o f the inhabitants o f the Bella Bella No. 1 Indian Reserve. AND WHEREAS the Council o f the Bel la Bella No. 1 Indian Reserve deem i t d es irab le t o amend by-law no. 14. NOW THEREFORE the Council o f the Bella Bella No. 1 Indian Reserve enacts as a by-law thereof the fo l low ing: 1. In th is by-law, (a ) "COUNCIL" means the Council, as defined in the Indian Act, o f the Be l la Be l la Band o f Indians. (b ) "RESERVE" means the t ra c t o f land set apart by Her Majesty within the d e f i n i t i o n o f :e Indian Act, f o r the use and benef i t o f the Bella Bel la Band o f Indians known as Bel la Bel la No. 1 Indian Reserve. (c ) "CHILD" means any boy or g i r l actually or apparently under s ixteen (16) years o f age. (d) "NIGHT" means the da i ly period o f time from nine o 'c lock in the afternoon to s i x o 'c lock in the morning during the months o f September through dune in c lu s iv e ; and th e da i ly period o f time from ten - th ir ty in the afternoon to s ix o 'c lo ck in the morning during the months o f July and August. 2. No boy or g i r l on the Bella Bella No. 1 Indian Reserve ac tua l ly or apparently under sixteen (16) years o f age, shall l o i t e r any place within Bella Bel la No. 1 Indian Reserve in the afternoon. 3. No boy or g i r l on the Bella Bel la No. 1 Indian Reserve ac tua l ly or apparently under sixteen (16) years o f age, shall be in any place o f entertainment, s t r e e t , lane , by-way or common within the said reserve a f t e r the hour o f nine o 'c lock in the a fternoon o f Sundays Thursday inc lus ive and a f t e r the hour o f t en - th ir ty in the afternoon o f Fr idays, Satur days and day preceeding hol idays, unless accompanied by his or her parent or an adu lt appointed by a parent to acçompany such child. 4. A boy or g i r l on the Bella Bel la No. 1 Indian Reserve found v i o l a t i n g the p rov is ions o f paragraph (2) or (3) may be warned (3 times) and conducted home by a p o l i c e o f f i c e r , and i f the warning is not regarded or a f t e r the warning the boy or g i r l i s again found disobeying said paragraph (2) or (3) the parents or guardian o f such boy o r g i r l w i l l be 3 warned and served a not ice o f warning a f t e r a third o f fense o f his ch i ld . 5. Any parent or guardian shall be summoned fo r permitting his ch i ld hab i tua l ly to break said by-law, a f t e r having being warned in writ ing and shall be l i a b l e on summary conv ic t ion to a f ine o f $25.00 fo r each conviction. 6. For specia l community evening events sponsored and supervised by adu lts , the curfews mr/ba ox tended to a la t e r time provided permission in wri t ing is granted by Counci l, o r i t s delegated authority and that the local po l ice detachment is n o t i f i e d o f the spec ia l permit.
