THE BOSTON BAR BAND OF INDIANS sx./8o-'n i BY-LAW NO. 1980-1 Being a by-law to provide regulations fo r occupancy and building maintenance standards. WHEREAS under the provisions o f the National Housing Act no loan may be made by the Canada M ortgage and Housing C o rp o ra t io n (h e r e in a f t e r c a l le d the C o r p o r a t io n ) f o r the p u rp ose o f r e h a b i l i t a t io n o f e x i s t i n g r e s i d e n t i a l b u i ld in g s u n le s s standards o f occupancy and build ing maintenance s a t is fa c t o r y to the Corporation have been adopted in the R eserve in which the bu ild ing is loca ted ; AND WHEREAS the Council o f the Band deems i t expedient to make a b y -law p r e s c r ib in g the minimum stan dards fo r occupancy and build ing maintenance o f a l l properties reh a b ilita ted through the R e s i d e n t i a l R e h a b i l i t a t i o n A s s i s t a n c e P rog ra m o f th e Corporation; AND WHEREAS s e c t io n 8 1 (h ) , (q ) and ( r ) o f th e In d ia n A ct empowers the Council o f a Band to make by-law s fo r the purpose o f r e g u la t in g c o n s tr u c t io n , re p a ir and use o f b u ild in g s on reserves and the im position on summary c o n v ic t io n o f a f in e or imprisonment fo r v io la t io n o f a by-law . NOW THEREFORE the Council o f Boston Bar Band o f Indians en acts as a by-law the fo llow in g : This by-law sh a ll be known as the Boston Bar Band RRAP Standards By-law No. 1 1980; In th is by-law "Building Inspector" means a p erson a u th orized by Council .to inspect bu ild ings on the R eserve as se t out in th is By-law; "Corporation" means the Canada Mortgage and Housing Corporation; "Council means the duly e le c te d c o u n c il o f Boston Bar Band o f Indians. "Owner means a person who has lega l t i t l e to or i s in possession o f a build ing situated on the re se rv e or land which has been su rren d ered to Her M ajesty fo r leasing purposes and in clu d es a person who has received a loan under Section 3;
- 2- RRAP" means th e R e s id e n t ia l R e h a b i l i t a t i o n Assistance Program o f the Corporation; Reserve means tra ct o f land set aside f o r the use and ben efit o f the Boston Bar Band o f Indians 3 . Every person who has r e c e iv e d a lo a n from th e Corporation fo r the purpose o f re h a b ilita t io n o f an ex istin g real property lo c a te d w ith in the R eserve through the RRAP sh a ll comply with the occupancy and b u ild in g m aintenance standards as s e t f o r t h in Schedule 'A ' referred to in section 4 . 4. The standards fo r the re h a b ilita t io n o f r e s id e n t ia l b u ild in g s issu ed by the C o rp o r a t io n a r e h e re b y amended f o r th e p u r p o s e s o f m a in te n a n ce and occupancy and form part o f th is by -law as Schedule 'A* hereto. 5. Where, in the o p in io n o f the B u ild in g I n s p e c t o r , work is required, to maintain the reh a b ilita tion made o f rea l property through the RRAP, in conformitywith Schedule 'A ', the Building Inspector may give n otice to the owner o f the property sp ecify in g the work to be done and the period o f time w ithin which the work is to be completed. 6. Every person who r e c e iv e s n o t ic e r e fe r r e d to in section 5 sh a ll comply w ith a l l the terms o f such n o t ice . 7 . Every person who a p p l i e s f o r a lo a n from th e Corporation as stated in section 3 sh a ll perm it the Building Inspector reasonable access to the property intended to be r e h a b il ita te d through the RRAP f o r the purpose o f determining whether such p rop erty is e l ig ib le fo r the RRAP a ssis ta n ce .

Every person who has r e c e iv e d a lo a n from the Corporation as stated in section 3 sh a ll perm it the Building Inspector reasonable access to the property a s s is t e d th rou g h the RRAP f o r th e p u rp o se o f determining whether the p r o v is io n s o f t h is by -law are being or have been complied w ith. 9 . Every person who has r e c e iv e d a lo a n from th e C orp ora tion as s ta te in s e c t io n 3 s h a l l use th e r e h a b i l i t a t e d prem ises s o l e l y f o r r e s i d e n t i a l purposes and in a manner c o n s i s t e n t w ith th e standards o f maintenance as p re scr ib e d in Schedule 'A '. 10. The Council may from tim e to tim e app oin t one or more p e rso n s who s h a l l p e r fo rm th e d u t ie s o f Building Inspector as p rov id ed by th is b y -la w . A person so appointed sh a ll hold the p o s i t io n at the pleasure o f the Council. 1 1 . E v e r y p e r s o n who f e e l s a g g r i e v e d b y th e determination o f the Building In s p e c to r may upon a w ritten app lica tion req u est the C ou n cil to rev iew the determ in ation o f the B u ild in g I n s p e c t o r , and upon rece ip t o f such a p p lica tion , the C ouncil s h a ll w ith in sev en days r e v ie w in open m e e tin g th e a p p lica tion . Both the a p p lica n t and the B u ild in g In sp e c to r may c a l l e v id e n ce , be r e p r e s e n t e d by c o u n s e l , c r o s s - e x a m i n e w i t n e s s e s and make submissions; the Council sh a ll fo r th w ith d e l iv e r a d ecis ion on the app lica tion . The d ec is ion s h a l l be binding and f in a l . 12. Every person who impedes or in t e r fe r e s w ith the conduct o f the work o f the B u ild in g I n s p e c t o r , or who v io la tes any provisions o f th is By-law s h a l l be g u ilty o f an o ffen ce and sh a ll be l ia b le on summary c o n v ic t io n to a f in e not e x ce e d in g one hundred d o lla rs or im prisonm ent fo r a term not ex ceed in g th irty days, or both, fin e and imprisonment.

SCHEDULE 'A* STANDARDS FOR MAINTENANCE AND OCCUPANCY SERVICES AND FACILITIES U t il it y s h u t -o f fs fo r common s e r v ic e s such as w ater, sewer, gas and e le c t r ic i t y in each housing unit sh a ll be maintain in good repair as determ ined by the B u ild in g Inspector. DILAPIDATED BUILDINGS A l l d ila p id a te d p o r t io n s o f s t r u c t u r e s , a n c i l l a r y b u ild in g s and fe n ce s as determ ined by the B u ild in g Inspector sh a ll be removed or repaired . PROTECTION AGAINST TERMITES AND OTHER PEST INFESTATION Where the presence o f te rm ites or p ests is ev id en t or suspected, appropriate measures f o r ex term in a tion and p ro te ctive measures against future term ite in fe s t a t io n sh a ll be undertaken. WALKS AND DRIVEWAYS Walks and d r iv e w a y s s h a l l be r e s t o r e d t o a s a fe con d ition as determined by the Building In sp ector where they con stitu te a sa fety hazard. SITE DRAINAGE Adequate surface water drainage away from the s tr u c tu r e sh a ll be provided in a manner determined by the Building Inspector., FIRE PROTECTION A high degree o f sa fety to l i f e and the p r o t e c t io n o f property sh a ll be provided by the use o f m aterials which retard the spread o f f i r e and prevent the passage o f flam e, smoke and hot gasses through open or con cea led spaces w ithin the b u ild in g , and by m aintain ing e x it s which w il l perm it persons to le a v e the b u ild in g w ith sa fe ty . Smoke alarms and f i r e e x t in g u is h e rs s h a ll be maintained in an operating c o n d it io n as determ ined by the Building Inspector.
- 2-4.1 STRUCTURAL - GENERAL A ll s t r u c tu r a l components o f the b u i ld in g s h a l l be sound. Structural members in a s e r io u s ly d e te r io r a te d c o n d it io n (as determ ined by the B u ild in g I n s p e c to r ) s h a l l be r e p la c e d . L oose j o i n t i n g o f s t r u c t u r a l members, sagg in g r o o f s , f l o o r s , i n t e r i o r s t a i r s , e x te r io r la n d in g s /s ta ir s , b a lc o n ie s and bu lg in g w a lls s h a l l be r e s t o r e d , as fa r as p r a c t i c a b le , to t h e i r o r ig in a l p o s it io n and f ir m ly supported or b ra ced , or sh a ll be replaced . I t is essen tia l that the s t r u c tu r a l in te g r ity o f the building is restored as necessary. 4 .2 FOUNDATIONS Foundations sh a ll be restored to ensure that they s h a l l reasonably support the loads imposed and to a standard as determined by the Building In sp ector. When mositure or wate penetration w il l cause s t r u c tu r a l damage or loss o f use o f the basement or crawlspace, the foundation w alls sha ll be dam pproofed or w a terp roofed and drainage provided. Craw lspace s h a ll be vented to the e x t e r i o r . They s h a ll be p r o v id e d w ith a c c e s s hatches. 4 .3 EXTERIOR WALLS E xterior w alls sh a ll be m aintained in sound c o n d it io n capable o f supporting l ik e ly load s, e .g . dead loads, and preventing the entry o f moisture in to the house. 4 .4 INTERIOR WALLS AND COLUMNS I n t e r i o r w a l l s , p a r t i t i o n s and colu m n s s h a l l be maintained in a sound c o n d it io n as determ ined by the Building Inspector. Load bearing w a lls , p a r t it io n s and columns sh a ll be capable o f supporting l ik e ly loads e .g . f lo o r loads.

Basement and crawl space f l o o r s s h a ll be dampproofed. 5. CAULKING Joints around d oors and window fram es, lo u v r e s , fan s e t c . , and a l l other unprotected jo in t s in the e s t e r i o r c o n s tr u c t io n s h a l l be ca u lk e d o r r e c a u lk e d w here necessary to prevent the entry o f moisture or d ra fts . 6. WINDOWS E xisting windows including hardware sh a ll be m aintained in an a c c e p ta b le c o n d it io n . D e fe c t iv e hardware and d e t e r i o r a t e d s a s h and fra m e m em bers s h a l l be r e p a ir e d /r e p la c e d to r e s to r e the windown t o a sound con d ition as dtermined by the Building In spector. 7. DOORS E x is t in g d oors and hardware ( in c lu d in g storm d o o rs ) s h a l l be m a in ta in e d e x c e p t w here the d e g r e e o f d eter io ra tion and/or damage ju s t i f i e rep lacem en t. A ll ex te r io r door sh a ll be e f fe c t iv e ly weatherstripped.
- 4-8.1 EXTERIOR WALLS AND ROOFS A l l e x t e r io r w a lls and r o o fs s h a ll be m aintained to prevent the en try o f m oisture in to the s tru c tu re and provide reasonable d u r a b i l i t y . A ll e x t e r io r m a te r ia l sub ject to d eter iora tion in i t s inprotected s ta te s h a ll be painted or otherwise su itab ly treated . T o ta l r e - r o o f in g s h a ll be made on ly where r e p a ir or replacement o f section is im practicable. 8.2 INTERIOR WALLS AND CEILINGS Cracks and d efects in in te r io r wall and ce ilin g fin ish es sh a ll b repaired . Water r e s is ta n t f in is h e s around show er s t a l l s and bathtubs in bathrooms sh a ll be maintained. 8 .3 FLOORS AND STAIRS F lo o r s and s t a i r f i n i s h e s c r e a t in g h a za rd ou s o r u n sa n itary c o n d it io n s as determ ined by the B u ild in g In s p e c to r s h a l l be r e p la c e d . H a n d ra ils s h a l l be provided. 9.1 BUILDING SERVICES A ll heating systems sh a ll be maintained in a a clean and safe operating con d ition . No combustible m aterial sh a ll be permitted adjacent to heating system. Every vent p ip e , chimney and smoke p ipe s h a l l have s u f f i c i e n t c le a r a n c e o r be p r o t e c t e d to p r e v e n t overheating o f adjacent com bu stib le m a te r ia ls and the entrace o f noxious gases in to the dw elling. Smoke p ip e s s h a l l have a minimum c le a r a n c e from unprotected combustible m aterials as fo llow s : a ) O il and gas burning appliances - 230 mm b) Solid fu e l burning apliances - 450 mm
- 5-Smoke pipes sh a ll be replaced i f the ex istin g p ip es are d eter iora ted . Pipes sh a ll be in s ta lled with s u f f i c i e n t h a n g e rs /s tra p s to avo id sa g g in g . Dampers s h a l l be provided. The pipes sh a ll be sized according to the manufacturer's sp e c ifica t io n s fo r the heating equipment. The Canadian Heating V e n t ila t in g and A ir -C o n d it io n in g Code 1977/and o f the la t e s t a d d it io n is to be used to determine "good p ra c t ice " . PLUMBING A ll d e fe c t iv e p lu m bin g p i p e s , f i x t u r e s , e t c . , as determined by the Building Inspector s h a ll be re s to re d to a sound cond ition and protected from freezin g . Galvanized pipe fo r dom estic hot water system s may be re p la ce d by o th er a c ce p ta b le p ip in g where th e r e i s evidence o f s ig n ifica n t corrosion or re s tr ic te d flow s. SEWAGE DISPOSAL An acceptable means o f sewage d isposal as determ ined by the Building In s p e c to r or by a r e p re s e n ta t iv e o f the Regional D ir e c to r , Department o f N ation a l H ealth and Welfare sh a ll be maintained. Acceptable is deemed to include any method o f d is p o s a l which complies with the requ irem ents o f the a u th o r ity having ju r is d ic t io n . ELECTRICAL SERVICES The e le c t r i c a l d i s t r ib u t io n system e .g . panel b o x e s , w irin g , recep tab les , e t c . sh a ll be m aintained in sound and safe con d ition as required by the a u th o r ity having ju r is d ic t io n .
