LIARD RIVER INDIAN BAND BY-LAW #1 -1990 TRESPASSING BY-LAW WHEREAS paragraphs (p) and (r) of section 81 of the Indian Act empowers the Council of the Band to make by-laws to provide for the removal and punishment of persons trespassing upon the Reserve or frequenting the Reserve for prohibited purposes; AND WHEREAS for the benefit, comfort and safety of the inhabitants of Liard Indian Reserve #3 it is deemed to be expedient and necessary to provide for the removal and punishment of persons trespassing upon the Reserve or frequenting the reserve for prohibited purposes. NOW THEREFORE the Council of the Liard Indian Band enacts as follows: 1. In this by-law: (a) "Council" means the Council, of the Liard River Indian Band, as defined in the Indian Act, (to)'*'":'*DeptJty*Chfef anrd Councrr means the DefHJty Chief and Council of Liard Indian Reserve #3 as appointed or elected from time to time in accordance with the custom of the Liard River Indian Band;
(c) "Reserve" means that tract of land set apart by Her Majesty for the use and benefit of the Liard River Indian Band and which is known as Liard Indian Reserve #3; t (d) "Constable" includes a police officer, a By-law Enforcement Officer, a Band Constable or any person appointed for the purpose of maintaining law and order on Liard Indian Reserve #3. 2. No person may trespass upon the Reserve, or fret|uest the Reserve for prohibited purposes. 3. No person, other than person who has a right to be on the Reserve, shall remain on the Reserve after receiving proper written notice from the Council or Deputy Chief and Council to vacate the said Reserve. 4. Any person who violates any of the provisions of this by-law shall pursuant to section 30 of the Indian Act, be guilty of an offence and shall be liable upon summary conviction to a fine not exceeding $50.00 or imprisonment for a term not exceeding one month or to both a fine and imprisonment. iv Approved and passed at a duly convened meeting of the Council of the Liard River lndian Banditti's 18 dav of Apri1__________ . 1990.
