LIARD RIVER INDIAN BAND BY-LAWS #3-1990 BY-LAW RESPECTING THE OBSERVANCE OF LAW AND ORDER WHEREAS section 81 (c) and (d) of the Indian Act empowers the Council of an Indian Band to enact by-laws for the observance of law and order the prevention of disorderly conduct and nuisances, and the imposition of a penalty for the violation thereof; NOW THEREFORE the Council of the Liard River Indian Band enacts as follows: 1. In this by-law (a) "Constable" includes a police officer, a By-law Enforcement Officer, a Band Constable or any person appointed for the purpose of maintaining law and order on Liard Indian Reserve #3; (b) "public place" includes any place on or in Liard Indian Reserve #3 to which the public have access as of right or by invitation express or implied; te) Reserve"Tnenasihât 1ract of land set «part l y Wer Majesty for the use and benefit of the Liard River Indian Band and which is known as Liard Indian Reserve #3.
2. No person shall cause a disturbance in or near a public place (a) by fighting, screaming, shouting, swearing or using insulting or obscene language; * (b) by being drunk, or impaired by drugs, or (c) by impeding or molesting other persons. 3. No person shall openly expose or exhibit an indecent exhibition in a public place or commit any act in a public place which offends against public decency or order. m: 4. No person shall loiter in a public place or in any way obstruct persons who are there. 5. No person shall disturb the peace and quiet of the occupants of a dwelling house by discharging fire-arms, or by other disorderly conduct in a public place, or dwelling house. 6. No person shall without lawful excuse, the proof of which lies upon him, p ro t^T rtid ilB rl^ iday or byTTfgtitupon the pfoperty of another person near a dwelling house situated on that property without the owners permission either express or implied. 7. A Constable shall have the power and authority to arrest any persons who violates any of the provisions of this by-law.
8. Any person who violates any provisions of this by-law shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding $500.00 or imprisonment for a term not exceedirfg 30 days or both fine and imprisonment.
