YUKON TERRITORY DIDPOSAL OF GARBAGE BY-LAW The Council of the fammss Tapish Tndian Band of Indians at a meeting this , 17i-h day of Dpppnhpr 19 85 hereby enacts by-law number 7 to provide for the regulation of the disposal of garbage waste. Whereas Paragraph (a) and (r) of Section 81 of the Indian Act empowers the Council of a band to make by-law to provide for the health of residents in the Reserve and to prevent the spreading of contagious and infectious diseases and the imposition of penalty for a violation thereof, and, Whereas it is deemed to be expedient to control the disposal of garbage and waste for the health and welfare of the inhabitants of the Carcross Tagish Indian Band Now therefore the Council of the Carcross Tagish Indian______________ Bands of Indians enacts as a by-law thereof the following: 1. In this by-law: (a) "Council" means the Council as defined in the Indian Act. (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the__ carcross Tagish indtan Band of Indians known as the Carcross Tagish Indian Band_____________________________ (c) "Premises" means lands and residences within the Reserve. 2. No person shall accumulate or permit to be accumulated upon premises in his possession or deposit or accumulate on premises in possession of another person anything which is or may become offensive or in­ jurious to health. 3. No person shall deposit any dead anamil, offal fish, manure, garbage, fruit, vegetables, night soil, filth, liquid waste, human excretion, or anything of a nature which is or may become offensive or pre­ judicial to health upon or into any highway, street, road, alley, lane, lot, ditch, wharf, dock, pond, river, stream, well, or sewer or into and premises within the Reserve and any such deposit shall be deemed a nuisance, provided, however, that the provision of this paragraph shall not apply to the deposit and proper disposal of any such waste and material into or at a place within the Reserve approved by the Council for that purpose. 4. The Council may arrange for a regular removal of garbage and waste from any premises within the Reserve. 5. In the spring of each year, as soon as the melting of snow premits the person residing in any premises within the reserve shall collect all waste matter lying thereon including tin cans, bottles, paper and animal manure. 6. All such waste matter shall disposed of in such a manner as will prevent any nuisance or offence as the fouling or polluting of wells and water supply. 7 7. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on a summary con­ viction of a fine not exceeding $100 or imprisonment for a term not exceeding 30 days or both fine and imprisonment.
