POUND BY-LAW The uneil o f the Swan Lake Band of Indians at a meeting held this 22 day of August, 1977 hereby enacts by-law number 10-77 to provide fo r the regulation o f domestic animals within the boundaries of the Swan Lake Indian reserve. Whereas; paragraphs (e ) and (r ) o f section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for the protection against and prevention o f trespass by ca ttle and other domestic animals, the establishment of pounds, the appoint­ ment. o f pound-keepers, the regulations o f their duties and the provision for fees and charges fo r their services and the imposition o f a penalty for a v io la tion thereof, and Whereas; i t is deemed to be expedient to providfe for the regulation o f cows or other domestic animals for the protection of property and the safety of the inhabitants of the Swan Lake Indian reserve. Now therefore the Council o f the Swan Lake Band of Indians enacts as a by-law the fo llow ing: 1. In this by-law: (a ) "Council11 means the Council as defined in the Indian Act o f the Swan Lake Band o f Indians. (b) "Reserve" means the tract o f land set apart by Her Majesty within the d e fin ition o f the Indian Act, for the use and benefit of the Swan Lake Band of Indians known as the Swan Lake Reserve* \c) "Animal" means a domestic animal and includes any horse, cow, pig, ass, goat, sheep, c a lf , bullock, mule, s ta llion , bu ll, boar, or jackass. (d) "Fence" means any enclosure made o f w ire, wood, stone, or earth to keep animals in or out. (e ) "Pound" means an enclosure fo r the detention of stray animals or o f distrained animals t i l l redeemed. ( f ) "Pound-keeper" means any person appointed by the Chief and Council fo r the purpose o f this by-law. (g ) "Run at large" or "running at large" means an animal that is o f f the premises of i t s owner and is not under e ffe c t iv e control o f some person or a fence. (h) "Road" means highway, route, a lle y , path, causeway, street, thoroughfare, or avenue. ( i ) "Crop" means wheat, oats, barley, rape, fla x , m ille t or any domestic plants special or otherwise. 2. The Council shall appoint a pound-keeper fo r the Reserve who shall hold o f f ic e during the term of the Council. 3. The. Council shall establish a pound book which shall contain a l l pertinent information pertaining to the Impoundment o f animals and shall be kept by the pound-keeper which w ill at a l l times be open fo r inspection o f the Council or any member thereof. 4. The. Council shall establish a policy manual containing the rules and regulations to be enforced by the pound-keeper and the said manual shall come under the ju risd ic tion of this by-law. 5. No person shall allow his animals to run at large on roads, crops, gardens or in ether peoples property. 6. Every owner of an animal shall erect or cause to be erected a fence to control his/her animal and the said owner shall be responsible to maintain that fence to protect his/her property and the property o f others. 7. Any person who v io la tes any of the provisions o f this by-law shall be gu ilty o f an offence and shall be l ia b le on a summary conviction to a fin e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both fin e and imprisonment.
