JAN 1 9 1979 The Council of the Shamattawa Band of Indians at a meeting 85084 held this . day of January, 1979 hereby enacts by-law number 1 to provide for a means to regulate the activities of the people actually or apparently sniffing gasoline, glue or other such substance within the boundary of the Shamattawa Reserve. Whereas Paragraphs (c), (d), and (r) of section 81 of the Indian Act empowers the Council of a Band to make by-laws respecting the behaviour and conduct of Band members and the imposition of a penalty for the violation thereof ; And whereas the sniffing of gasoline or glue or other such substances often results in disorderly conduct and nuisance. That whereas the Council of the Shamattawa Band deems it necessary to restrict such activities. Now therefore the Council of the Shamattawa Band of Indians enacts a by-law thereof the following : 1 In this by-law, (a) "Council means the Council, as defined in the Indian Act of the Shamattawa Band of Indians ; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Shamattawa Band of Indians known as the Shamattawa Reserve. (c) "Person" means anybody on the Shamattawa reserve land. 2 No person on the Shamattawa Indian Reserve shall purposely sniff gasoline or glue or any such substance. 3 No person on the Shamattawa Indian Reserve shall be under the influence of sniffing gasoline or glue or any such substance. 4 No person on the Shamattawa Indian Reserve shall allow children to sniff gasoline or glue or any such substance in their presence or place of residence. 5 Any person on the Shamattawa Indian Reserve found violating the provisions of section (2) or (3) may be apprehended by a police officer or by whomever is authorized by the Band Council for a period of time not exceeding 12 hours. 6 Any person on the Shamattawa Indian Reserve found guilty of violating section (2) or (3) or (4) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding $100. or imprisonment for a term not exceeding 30 days or both fine and imprisonment.
