By-Law No._____ to Control Intoxicants Fort Churchill indian Band Whereas a majority of the electors of the Band who attended a special meeting of the Fort Churchill Indian Band on December- 8th,1986 A.D. called by the council of the Fort Churchill Indian for the purpose of considering the contents of this by-law, consented to the contents of this by-law, and Whereas the Fort Churchill Indian Band Council considers it necessary to have special measures for the protection of the in­ habitants of the reserve(s) of the Fort Churchill Indian band from the presence of intoxicants. Now therefore, it is hereby enacted pursuant to section 85.1 of the Indian Act. Definitions : 1. In this by-law. Intoxicants: includes alcohol, alcoholic spiritous,venooss fermented malt or other intoxicating liquor or combination of liquors and mixed liquor a part of which is vinous, fermented or ' otherwise intoxicating and all drinks or drinkable liquids, and all preparations or mixtures capable of human consumption that are intoxicating. 2. Prohibition on Sale, Barter, Supply or Manufacture. Everyone who sells, barters, supplies or manufactures intoxicants on the reserve(s) of the Fort Churchill Indian Band is guilty of an offence punishable on summary conviction. 3. Prohibition Against Intoxication. Everyone who is intoxicated on the reserve(s) of the Fort Churchill Indian Band is punishable on summary conviction. 4. Prohibition or Possession of Intoxicants. Everyone who is in possession of intoxicants is guilty of an offence punishable on summary conviction. Cont'd next page
5. Penalties For greater certainty, the penalties for controvention of this by-law are set out in the Indian Act. This by-law made enacted on December 10th,1986 in Tadoule Lake Manitoba. AFFIDAVIT residing names capacity at the Fort Churchill Indian Band reserve(s), make oath and swear that I was present at a special meeting of the Fort Churchill Indian Band called by the council on December 8th,1986. That in this special meeting, a majority of electors present assented unanimously to the by-law presented to control intoxicants on the reserve(s) of the Fort Churchill Indian Band. That the majority of electors present at the meeting was in \ number 54. Date: December 10,1986
