WEAPONS BY-LAW The Council of Sandy Bay Band of Indians at a meeting held this 14th day of October, 1977 hereby enacts by-law No. 8 to provide for the regulation of weapons within the boundaries of Sandy Bay Indian Reserve. Whereas paragraphs (c), (d) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws respecting the observance of law and order, the prevention of disorderly conduct and the imposition of a penalty for the violation thereof; and, Whereas it is deemed to be expedient to control the manner of employ and display of weapons within the boundaries of the Sandy Bay Indian Reserve for the safety and well-being of the inhabitants thereof. Now therefore the Council of the Sandy Bay Band of Indian enacts as a by-law thereof the following: 1. In this by-law, (a) "Council means the Council as defined in the Indian Act of the Sandy Bay Band of Indians; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act, for the use and benefit of the Sandy Bay Band of Indians known as the Sandy Bay Reserve. (c) "Vehicle" means any conveyance that is driven, propelled or drawn by any kind of power. (d) "Weapon" means any object or instrument which may be used to inflict personal injuries or which is dangerous to the public peace. 2. No intoxicated person shall, upon any street, road or inhabited area within the boundaries of Sandy Bay Indian Reserve carry or attempt to carry a weapon. 3. No person shall on the Sandy Bay Indian Reserve actually or apparently under 16 years of age have in their possession or be allowed to handle or attempt to handle a weapon without adult supervision. 4. No person shall carry a weapon concealed in his/her attire. 5 A weapon carried in a vehicle within the Sandy Bay Indian Reserve shall be kept inconspicuous and in a manner that no person will have immediate access. 6. Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable to a summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days, or both fine and imprisonment. 7. A parent or guardian who permits his/her child or ward to violate Section 3 of this by-law shall be guilty of an offence and shall be liable to a summary conviction pursuant to Section 6 of this by-law.
