BUSINESS BY-LAW The Council of the Sandy Bay Band of Indians at a meeting held this 14th day of October, 1977 hereby enacts by-law No. 12 to prohibit the carrying on of any class of business, trade or calling within the boundaries of the Sandy Bay Reserve. Whereas paragraphs (g) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for the regulations of the construction or maintenance of any class of a building for the carrying on of any class of business and the impostion of a penalty for the violation thereof; And whereas it is deemed expedient and necessary to provide for the control to regulate any class of business for the benefit of the Indian Reserve and its inhabitants. Now therefore the Council of the Sandy Bay Band of Indians enacts as a by-law thereof the following: 1. In this by-law, (a) "Council means the Council, as defined in the Indian Act of the Sandy Bay Band of Indians; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act for the use and benefit of the Sandy Bay Band of Indians known as the Sandy Bay Reserve. (c) "Building" means any structure, that is erected for the purpose of carrying on any class of business. (d) "Business" means store, garage, filling station, pool hall, dance hall, laundromat or any and all occupations engaged in commerce for lucrative purposes. 2. No person or persons shall erect a building for the purpose of conducting a business within the Sandy Bay Indian Reserve without the written consent of the Chief and Council granting permission to construct a building indicating the nature or conduct of said business. 3. No person or persons shall establish any kind of business on the Sandy Bay Reserve without the written authorization of the Band Council. 4. Any person who violates any of the provisions of this by-law shall be guilty of an offence, and shall be liable on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days, or both fine and imprisonment.
