CONSTRUCTION BY-LAW The Council of the Sandy Bay Band of Indians at a meeting held this 14th day of October, 1977 hereby enacts by-law No. 11 to regulate the construction, repair and the use of buildings, whether owned by the band or by individual members of the Sandy Bay Indian Reserve. Whereas, paragraph (h) and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for the regulation of the construction, repair and use of buildings and the imposition of a penalty for a violation thereof, and Whereas, it is deemed expedient and necessary to regulate and control the construction, repair, and use of buildings for the benefit of the Sandy Bay Indian Reserve and its inhabitants. Now therefore the Council of the Sandy Bay Band of Indians enacts as a by-law thereof the following: 1. In this by-law, (a) "Council" means the Council as defined in the Indian Act of the Sandy Bay Band of Indians. (b) "Reserve" means the tract of land set apart by Rer Majesty within the definition of the Indian Act, for the use and benefit of the Sandy Bay Band of Indians known as the Sandy Bay Reserve. (c) "Building" means any structure erected by the band or,by an individual member for the purpose of a dwelling, store or shed. (d) "Occupied land" means (i) Any parcel of land set is held under lease or rent. (ii) Lots set aside by the Council for band projects or (iii) Any land that is used by an individual Band member. 2. No person shall construct or attempt to construct a building on any occupied land without the occupants written permission. 3. No building shall be erected within the boundaries of the Sandy Bay Indian r t e he s er B v an e d . without proper planning and in consultation with the Council of 4. No person shall repair to use or attempt to repair to use a vacant house without the written consent of the owner and in consultation with the Band Council. 5. Any person who violates any provision of this by-law shall be guilty of an offence, and shall be liable on summary conviction to a fine not exceeding $100.00 or imprisonment for a term not exceeding 30 days, or both fine and imprisonment.
