PUBLIC WATER SUPPLY BY-LAW 3 -3 -J S f 7 7 The Council of the Roseau River Band of Indians at av meeting held this 22nd day of August. 1977 hereby enacts by-law number 4-77 to provide for the regulation of public water supplies within the boundaries of the Roseau River Indian Reserve. Whereas, paragraphs (a), (1), and (r) of Section 81 of the Indian Act empowers the Council of a Band to make by-laws to provide for the regulations of the use of public water supplies, and the imposition of a penalty for a violation thereof, and Whereas, it is deemed to be expedient to provide for the regulation of the use of public water supplies for the health, safety and welfare of the inhabitants of the Roseau River Indian Reserve. Now therefore the Council of the Roseau River Band of Indians enacts as a by-law thereof, the following: 1. In this by-law, (a) "Council" means the Council as defined in the Indian Act of the Roseau River Band of Indians; (b) "Reserve" means the tract of land set apart by Eer Majesty within the definition of the Indian Act, for the use and benefit of the Roseau River Band of Indians known as the Roseau River Reserve. (c) "Premises" means lands and residences within the Reserve. 2. No person shall wilfully or maliciously pollute and well, cistern, reservoir or other water supplier within the Roseau River Indian Reserve, in the Province of Manitoba. 3. No person shall destroy or damage any well, cistern, reservoir, or other water supplier within the Reserve. 4. The occupant of a premise within the P*eserve shall keep any well, cistern or reservoir thereon properly enclosed or covered. 5. No person shall deposit into or on the ice of or on the shores on any waters lying within the Reserve any night soil, garbage, manure, dead animal matter, decaying vegetable matter or any substance or substance which in any way may contaminate such waters and tend to make the waters therefrom unfit for human consumption. 6. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on a summary conviction to a fine not exceeding $500.00 or imprisonment for a term not exceeding 180 days, or both fine and imprisonment.
