DISORDERLY CONDUCT & NUISANCE BY-LAW Council o f the Long P la in Band of Indians at a meeting held this 22nd day of August 1977 hereby enacts by-law Number 7-77 to provide fo r the observance of law and order and fo r the prevention of d isorderly conduct and nuisance within the boundaries o f the Long Pla in Indian Reserve in the Province o f Manitoba. Whereas paragraph (c ) , (d ), and ( r ) o f Section 81 of the Indian Act empowers the Council o f a Band to make bylax̂ /s to provide £ox~ law and order and the prevention o f d isorderly conduct and nuisance and the imposition of a penalty fo r a v io la t io n thereof, and Whereas i t is deemed necessary to maintain law and order fo r the benefit and well being o f the inhabitants of Long Plain Reserve, Now therefore the Council o f the Long Plain Band o f Indians enacts as a by-law thereof the fo llow ing: 1. In this by-lav/: (a ) "Council means the Council as defined in the Indian Act o f the Long Plain Band o f Indians; (b) "Reserve" means the tract o f land set apart by Her Majesty w ithin the d e f in it io n o f the Indian Act, fo r the use and benefit o f the Long P la in Band of Indians known as the Long P la in Reserve. (c ) "Constable" means a person appointed for the purpose of maintaining law and order on the Long P la in Indian Reserve. (d ) "Public Place" means and includes anyplace, to which the public have access as o f r igh t or by in v ita t ion expressed or implied. 2. No person shall cause a disturbance in or near a public place, (a) by f igh t in g , screaming, shouting, swearing, singing, or using insu lting or obscene language; (b) by being intoxicated with any a lcoholic stimulant or drug, or (c ) by impeding or molesting other persons. 3. No person shall expose himself or herse lf or cause an indecent exh ib ition in a public place or commit any act in a public place which offends against public decency or order, 4. No person shall l o i t e r in a public place or in any way obstruct persons who are there. 5. No person shall disturb the peace and quiet o f the occupants o f a dwelling house by discharging fire-arms, shouting, swearing or using insulting or obscene language or by other d isorderly conduct in or near a dwelling house. 6. No person shall without lawful excuse, the proof o f which l i e s upon him, prowl or l o i t e r by day or by night upon or near the premises of another person without the occupants permission e ither expressed or implied.. 7. The Constable shall have the power and authority to arrest any person who v io la te any o f the provisions o f this by-law. 8. No person shall res is t or w i l fu l ly obstruct a Constable in the execution o f his duty or any person law fu lly acting in aiding such an o f f i c e r . 9. No person shall omit without reasonable excuse to ass is t a Constable In the execution o f his duty in arresting a person or in preserving the peace a f te r having reasonable notice that he is required to do so. 10. Any person who v io la tes any provision of this by-law sha ll be gu ilty o f an o ffence and shall he l ia b le to a summary conviction to a f in e not exceeding $100.00 or imprisonment fo r a term not exceeding 30 days or both f in e and imprisonment.
