SoKl$sr~//Si Qslc . 1 1 , 1 ° ^ GOD'S LAKE BAND OF INDIANS By-Law No. 2-85 Being a by-law to amend by-law registered under SOR 85-726 respecting intoxicants on reserve. WHEREAS the Council of the God's Lake Band of Indians did pass its by-law on July 10, 1985, respecting intoxicants; AND WHEREAS certain exceptions in the by-law have been brought to the attention of the Council; NOW THEREFORE the Council of the God's Lake Band of Indians in the Province of Manitoba makes as a by-law thereof"as follows -1. By-law registered under SOR 85-726 of the Council of the God's Lake Band of Indians passed on July 10, 1985 and respecting intoxicants be, and the same is hereby, amended by; a) deleting Section #3 "paragraph B (i) (ii) of by-law registered under SOR 85-726 of Section 85.1 of the Indian Act; b) deleting Sections 4 item (a) and (b) respecting permits ; Approved and passed at a duly convened meeting of the Council of the God's Lake Band of Indians this 26th day of November, 1985, as evidenced by the signatures given below being the majority of the Councillors of the Band present at the meeting. Whereas the G o d Ts Lake Band Council considers it n e cessary to provide, by by-law pursuant to Section 85.1 of the Indian A c t , for regulating the presence and use of intoxicants on the Reserves of the G o d s Lake Band; Now therefore it is enacted that; Definitions : 1. In this b y - l a w , a) ’’B a n d means the G o d s Lake Indian Band; b) ’’R e s e r v e means all of the Reserves set aside from time to time for the use and benefit of the Band, and include any special Reserve; c) ’’Band M e m b e r means a member of the Band; d) ’’R e s i d e n t means any person over the age of 18 years who is actually resident on the Reserve and has been actually resident on the Reserve for any continuous period of 6 months; e) ’’I n t o x i c a n t means any substance which is an intoxicant within the meaning of ’’i n t o x i c a n t s for the purposes of the Indian Act and which contains more than 1% by volume of any alcohol or alcohols ; f) ’’R e s i d e n c e means any building situated on the Reserve which is actually in use as the residence of any persons. Prohibitions : 2. a) Everyone who sells, barters, m a n ufactures or supplies to another person any intoxicant on the Reserve is quilty of an offence punishable on summary conviction. b) Everyone who possesses any intoxicant on the Reserve is quilty of an offence punishable on summary conviction. Exceptions : 3. N o t w i t hstanding anything in this by-law, no person commits an offence under this by-law by the possession or supply to another person of an intoxicant, a) which is manufactured for medicinal purposes only and is possessed or supplied for medicinal purposes only; b) deleted i) deleted ii) deleted
