DISPOSAL OF GARBAGE BY-LAW The Council of the DAKOTA TIPI BAND of INDIANS at a meeting held this 7 th day of October , 1981 hereby enacts by-law number three (3) to provide for the regulation of the disposal of garbage and waste within the boundaries of the DAKOTA TIPI INDIAN RESERVE. WHEREAS paragraph (a) and (r) of Section 81 of the Indian.Act empowers the Council of a Band to make by-laws to provide for the health of the residents on the Reserve and to prevent the spreading ot contagious and infectious diseases and the impo­ sition of a penalty for a violation thereof, and, WHEREAS it is deemed to be expedient to control the disposal of garbage and waste for the health and welfare of the residents Of the DAKOTA TIPI INDIAN RESERVE. NOW THEREFORE the Council of the DAKOTA TIPI BAND of INDIANS enacts as a by-law thereof the following: 1. In this by-law, (a) "Council" means the Council as defined in the Indian Act of the DAKOTA TIPI BAND of INDIANS; (b) "Reserve" means the tract of land set apart by Her Majesty within the definition of the Indian Act for the use and benefit of the DAKOTA TIPI BAND of INDIANS known as the DAKOTA TIPI RESERVE. (c) "Premises" means lands and residences within the Reserve and controlled by the Reserve. 2. No person shall accumulate or permit to be accumulated upon premises in his possession or deposit or accumulate on premises in possession ot another person anything which is or may become offensive or injurious to health. 3. No person shall deposit any dead animal, offal fish, manure, garbage, fruit, vegetables, night soil, filth, liquid waste, human excretion, or anything of a nature which is or may become offensive or prejudicial to health upon or into any highway, street, road, alley, lane, lot, ditch, river, stream, well or sewer or into any premises within the Reserve and any such deposit shall be deemed a nuisance, provided, however, that th© provison of this paragraph shall not applÿ to the deposit and proper disposal of any such tëèSië âhd tnéfeôtlal into or at a place within the Reserve approved by the Council for that purpose.
The DAKOTA TIPI BAND of INDIANS by-law No. 3 4. The Council may arrange for a regular removal of garbage and waste from any premises within the Reserve*. 5. In the spring of each year, as soon as the melting of snow permits the person residing in any premises within the Reserve shall collect all waste matter lying thereon including tin cans, bottles, paper, animal matter and old vehicles. 6. All such garbage and waste matter shall be placed in garbage bags and tied and then placed in the garbage cans which are suppled by the Band. 7. Any person who violates any of the provisions of this by-law shall be guilty of an offence and shall be liable on a summary conviction of a fine not exceeding $100.00 or impri­ sonment for a term not exceeding fifteen (15) days or both fine and imprisonment. Approved and passed at a duly convened meeting of the Council of the DAKOTA TIPI BAND of INDIANS this 7th day of October , 1981. A quorum for the Band consists of Four (4) Council members.
